HomeMy WebLinkAbout5514 - Seashore Colony Alley Vacation1111461 (12) 1 m- SOLUTION N0. • 2 A RESOLUTION OF INTENTION OF TIE CITY COUNCIL OF THE CITY OF NEWFOR ^s BEACH DECLARING ITS 3 IA, MION TO ORDER THE CLOSING UP, VACATION AND ABADMI- ENT OF A PORTICN CF AN ALLZ-Y IN 4 BLOCK 2 OF SEASHORE COLONY TRACT 6 The City Council of the City of Newport Beach, pursuant 7 to the provisions of the 94Street Vacation Act of 1941093 and all 8 amendments thereto, being Sections 8300 to 3331, inclusive, o` 9 the Streets and Isighways Code of the State of California, does 10 hereby resolve and declare as follows: 11 SECTION 1. The public interest and. convenience recui:ce 12 the closing up and abandonment of a portion of a certain alley 13 in Block 2 or Seashore Colony Tract in the City of Newport Beach, 14 and it is the intention of the City Council of the City of Newport 15 Beach to order the following described portion of said alley in 16 the City of Newport Beach, County of Orange, State of California, 17 to be vacated, closed nap and abandoned, to wit: 18 The northeasterly 1-65 feet 10 feet in width, in Block 19 Tract, iss the County of Or, as shown on a nap recorded 20 FAscellasneous haps, in the Recorder of said County. 21 of that ce:rtair°n alley, 2 of Seashore Colony zsnge, State of Caliro=nia, In Book 7, page 25 of Office of the County 22 All of that portion of said alley to be vacated, closed 23 up and abandoned is more clearly shown on a certain map approved 24 and adopted by the City Council of,the City of Newport Beach for 25 said vacations, closing rap and abandonment, by resolution dated 26 November 13, 1961, and designated "Resolution No.s-La2 which 27 said map is on file in the office of the City Cleric of the City of Is 28 Newport Beach. Reference is hereby made to said reap for further 29 particulars as to the ;proposed vacation, closing nap and abangdonm-e-t 30 of said portion of said alley, and said nap is made a part of this 31 resolutions by this reference to the same extent and purpose as if 32 it were incorporated herein in full. r f 1 SECTION 2. Me proceedings for the closing up and aban— 2 donxment of t-ie aforesaid portion of said alley shall be had and 3 taken, and the City Council of the City of Newport Beac';.a hereby 4 elects to proceed under the provisions of the "Street Vacations Lct 5 of 194193, and all amendments thereto, 'being Sections 8300 to 3331, 6 inclusive, of the Streets and Highways Code of the State of 7 California. 8 SECTION 3. The Street Superintendent of the City of 9 Newport Beach shall cause to be conspicuously posted along Vie lin 10 of the portion of said alley proposed to be vacated not more taan 11 300 feet apart, but not less than three in all, notices of the 12 vacation of said portion of said alley. Said notices shall state 13 the passage of this Resolution of Intention and the time and place 14 of the hearing of all persons interested in or objecting to the 15 proposed vacation of said portion of said alley. Said notices 16 shall be so posted at least ten days before the date of said 17 hearing, all as required by law. 18 SECTION 4. Notice is hereby given that the City Council 19 of the City of Newport Beach does hereby fix Monday, tlee 11th day 20 of December, 1961, at the hour of 7:30 o'clock F. T& of said day, 21 in the Council Chambers of the City of Newport Beach, located in 22 the City Hall of the City of Newport Beach, as the time and place 23 for wearing all persons interested in or objecting to the proposed 24 vacation of said portion of said alley, and the City Council at 25 said time and place will hear the evidence offered by any persona 26 interested in the vacation of said portion of said alley ?herein - 27 before described. 28 VECTICN 5.
