1 RESOLUTION NO. 5517
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF.AN .
3 AMENDMENT TO AGREFk& TT.BETWEEN TRAUTWEIN BROTHERS,
NEWPORT HARBOR POST,N_O..291,OF THE AMERICAN
4 LEGION' AND THE CITY

6 WHEREAS, the City of Newport Beach, Trautwein Brothers,
7 a co- partnership, marine contractors, and Newport Harbor Post 291
8 of the American Legion entered into a contract in 1958 under which
9 Trautwein Brothers constructed certain boat slips on City -owned
to property under lease to the American Legion; and
11 WHEREAS, additional improvements have been constructed
12 by Trautwein Brothers on said property; and
13 WHEREAS, an amendment has been prepared to said 1958
14 agreement which will provide for paying for the initial improve -
15 ments and the additional improvements and provides for a payment
16 to City amounting to 10% of the gross from said improvements
17 beginning July 1, 1968; and
18 WHEREAS, the City Council has considered the terms of
19 said amendment and found them to be reasonable and the improvement
20 to be of benefit to said City owned property;
21 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
22 Clerk be and are hereby authorized and directed to execute said
23, amendment on behalf of the City.
24 BE IT FURTHER RESOLVED that Resolution No. 5346 adopted
25 December 27, 1960, be rescinded.
