RESOLUTION NO. 5525
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AMENDING RESOLUTION NO. 5269 WHICH
ESTABLISHED PARKING CONTROL -AND PARKING FEES ON
THE BALBOA PARKING LOT .
WHEREAS, Resolution No. 5269 established parking control
and parking fees on the Balboa Parking Lot; and
WHEREAS, said resolution was amended by Resolution No.
5309; and
WHEREAS, it now appears necessary to further amend said
resolution by providing for a lump sum payment for use of the
parking lot as hereinafter designated;
NOW, THEREFORE, BE IT RESOLVED that Paragraph 3 of Reso-
lution No. 5269 as amended by Resolution No. 5309 be and is hereby
further amended to read:
"3. The -City Manager is hereby authorized and
directed to maintain parking control and charge fees not
to exceed the daily fees herein established after the
date the controls and fees have been discontinued and
prior to the date they are begun for the following summer
season on days when there are special circumstances which
result in a need for parking control on the Balboa lot
in order to assure orderly and efficient use of the lot.
The City Manager is also authorized to waive
the fees established herein where a special event is
being held of a charitable or civic nature and it is
in the interest of the City and the general public that
fees not be charged for the use of the parking lot in
connection with said special event.
After the daily control is discontinued in the
fall and prior to the date the control is imposed in the
summer, the City Manager is authorized to accept a lump
sum payment from a businessman or businessmen in the area
of the Balboa Parking Lot as compensation for opening the
lot to unrestricted public parking for a particular event
or events being held in the vicinity of the lot in lieu
of the charges that may otherwise be imposed."
