J J-, / A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE VACATION, CLOSING UP AND ABANDONMENT OF A PORTION OF AN ALLEY IN BLOCK 2 OF SEASHORE COLONY TRACT WHEREAS, the City Council of the City of Newport Beach did, on the 13th day of November, 1961, pass its certain Resolutic of Intention No. 5514, declaring its intention to order the vaca- tion, closing up and abandonment of a portion of a certain alley in Block 2 of Seashore Colony Tract in the City of Newport Beach, hereinafter more particularly described, pursuant to and in accore ance with the "Street Vacation Act of 194111, and all amendments thereto, being Sections 8300 to 8331, inclusive, of the Streets and Highways Code of the State of California; and WHEREAS,. the Street Superintendent of the City of Beach has caused to be posted conspicuously along the line of the portion of said alley proposed to be vacated, not more than 300 feet apart, and not less than three in all, notices of the vaca- tion of said portion of said alley, all of which will more fully appear from the affidavit of Joseph T. Devlin, Street Superintend. ent of the City of Newport Beach, on file in these proceedings; and WHEREAS, said notices so posted by the Street Superin- tendent of the City of Newport Beach stated the passage of said Resolution of Intention No. 5514 aforesaid, and the time and place of the hearing of all persons interested in or objecting to the proposed vacation of said portion of said alley; and WHEREAS, the City Council of the City of Newport Beach did set Monday, December 11, 1961, at 7:30 P. M. of said day as the time, and the Council Chamber of the City Council of the City of Newport Beach, located in the City Hall of the City of Newport Beach, as the place, for the hearing of all persons interested in or objecting to the proposed vacation of said portion of said I alley; and 2 WHEREAS, said Resolution of Intention No. 5514 aforesaid 3 has been published at least once in the Newport Harbor Ensign, a 4 newspaper of general circulation, printed, published and circulated 5 in the City of Newport Beach, and said publication was made more 6 than 15 days prior to the date set for the hearing of all persons 7 interested in or objecting to the proposed vacation, all of which 8 will more fully appear by th0 affidavit of Arvo E. Hasps, owner 9 and publisher of said Newport Harbor Ensign, on file in these 10 proceedings; and 11 WHEREAS, the City Council of the City of Newport Beach 12 has Beard the evidence, both written and verbal, of all persons 13 interested in the vacation of said portion of said alley in this 14 resolution more particularly hereinafter described, and finds from 15 all the evidence submitted that said portion of said alley describe 16 in said Resolution of Intention, and hereinafter described, is 17 unnecessary for present or prospective public street purposes; 18 NOW, THEREFORE, the City Council of the City of Newport 19 Beach finds and determines and hereby orders that the following 20 described portion of that certain alley in Block 2 of Seashore 21 Colony Tract in the City of Newport Beach, to wit: 22 The northeasterly 165 feet of that certain alley, 10 feet in width, in Block 2 of Seashore Colony 23 Tract, in the County of Orange, State of California, as shown on a map recorded in Book 7, page 25 of 24 Miscellaneous Maps, in the office of the County Recorder of said County, 25 26 is unnecessary for present or prospective public street purposes, 27 and that it be vacated, closed up and abandoned. • 28 The City Council further finds and determines, and it is 29 hereby ordered, that the public easement in the portion of said 30 alley as heretofore described has, upon the passage of this 31 resolution, ceased. 32 The City Council further orders that the City Clerk of 2. • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 the City of Newport Beach shall cause a certified copy of this Order, duly attested by her as the City Clerk, under the seal of the City, to be recorded in the office of the County Recorder of the County of Orange, State of California, immediately following the passage of this resolution.
