RESOLUTION NO, 5530
• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
• NEWPORT BEACH AMENDING CERTAIN PROVISIONS OF
SECTION VI OF RESOLUTION NO. 5289 RELATING TO
LEAVES OF ABSENCE
WHEREAS, Section VI of Resolution No. 5289 sets out leaves
of absence provisions; and
WHEREAS, it is necessary to amend the provisions herein-
after set out of said Section VI relating to limitations on use of
sick leave and bereavement leave;
NOW, THEREFORE, BE IT RESOLVED-
SECTION 1. Effective December 26, 1961, subparagraph a
of paragraph 2 of subsection B of Section VI of Resolution No. 5289
is amended to reads
''a. In General. Sick leave taken shall not be in excess of
that actually earned at the time it is taken. An employee
serving his initial probation period is eligible to use his
accumulated sick leave, provided that if for any reason his
City employment is terminated prior to the completion of such
probation period his final paycheck shall be reduced by the
value of the sick leave he has taken."
SECTION 2. Effective December 26, 1961, subsection E of
Section VI of Resolution No. 5289 is amended to read:
11E. Bereavement Leave. Whenever an employee having.a pro-
bationary or regu ar appointment is necessarily absent from
duty because of the death or critical illness where death
appears imminent of father, mother, brother, sister, wife,
husband, or child, such employee shall, upon approval by
his department head, be entitled to bereavement leave and
shall draw his regular compensation during such absence.
Such compensation is limited to 5 working days in any cal-
endar year. The limit for Fire Department personnel "on
12-hour shifts is 7k shifts.
An employee serving his initial probation period who takes
leave under this subsection and who for any reason terminates
his City employment prior to the completion of such probation
• period shall have his final paycheck reduced by the value of
the leave he has taken."
