RESOLUTION NO. 5547
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ACCEPTING A GRANT DEEP) FROM RESPLANs
INC., CONVEYING FEE TITLE TO PUBLIC.STREET RIGHTS!
OF -WAY IN TRACT NO. 4444
WHEREAS, the Final Map of Tract No. 4444 has been approved
by the City Council; and
WHEREAS, Section 9256.14(x) of the Newport Beach Muni -
8 cipal Code requites that the subdivider shall convey the real
9 property consisting of the public street and alley rights -of -way
10 surrounding a planned residential development to the City in fee
11 and.shall covenant therewith that the open space or recreational
12 area lots shall be continuously maintained for the exclusive use
13 and benefit of occupants of the family dwelling units in the sub -
14 division and that access and automobile storage shall be provided;
15 land
16 WHEREAS, Resplan, Inc., has delivered a grant deed convey -
17 ing to the City all such real property within said Tract No. 4444
18 to comply with said Section 9256.14(x); and
19 WHEREAS, the City Council has reviewed said document
20 and determined that it adequately provides for the requirements of
21 said Section 9256.14(a);
22 NOW, THEREFORE, BE IT RESOLVED that the City Council of
23 the City of Newport Beach does accept said grant deed and the City
24 lCierk is. authorized and directed to execute and attach a certificate
25 of acceptance and consent to the recording of said grant deed in
26 the County Recorder's office.
