1 RESOLUTION NO. 5582
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
3 CONTRACT.WITH THE COUNTY OF ORANGE .

5 WHEREAS, the City of Newport Beach and the County of
6 Orange entered into a lease in 1958 under which the County Dock
7 Property was to be leased for commercial development, and
8 WHEREAS, said contract required the lessee for that
9 purpose to complete a bulkhead along the entire waterfront area;
10 and
11 WHEREAS, said lease has subsequently been terminated and
12 the bulkhead left incomplete; and
13 WHEREAS, it would be to the mutual advantage of the City
14 and County to have said bulkhead completed and backfilled and
15 certain appurtenant drains completed as shoran on Plans and Specifi-
16 cations designated N -10 dated April 1962 on file in the office of
17 the Orange County Harbor District; and
18 WHEREAS, a contract between the County of Orange and the
19 City of Newport Beach has been prepared under which the County woul
20 have said work done by contract and the City pay 35% of the cost
21 under said contract and the cost of a survey and advertising for
22 bids therefor; and
23 WHEREAS, said contract with the County is fair and equift
24 table;
25 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
26 Clerk be and are hereby authorized to execute the same on behalf of
27 the City.
