2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NE1JPORT BEACH . AUTHORIZING THE EXECUTION OF AN
3 AGREEMENT REGAnING.OFF- STREET PARKING

5 WHEREAS, the City Council on November 13, 1962, authorizes
6 the execution of an agreement with Leon Fry, Frank C. Cortese, and
7 Charles40'Connor, Inc., a California corporation, providing for
8 offostreet parking on a separate lot from the building site in
9 connection with a motel authorized by Use Permit 776; and
10 WHEREAS, ownership of the subject property has been
11 changed from the above owners to Charles Gangi, Frank C. Cortese,
12 and Charles-O'Connor, Inc., prior to execution of the agreement;
13 and
14 WHEREAS, said Charles- O'Connor, Inc., Charles Gangi,
15 and Frank C.'Cortese now wish to construct a motel on Lots 9 to 13,
16 inclusive, and all of Lot 14 except the southwesterly 15 feet
17 thereof, in Block 2, of Seashore Colony Tract, in the City of
18 Newport Beach, and are willing to provide the off- street parking
19 on Lots 7 and 8 in Block 3 of said Seashore Colony Tract; and
.20 WHEREAS, the Newport Beach Municipal Code provides that
21 off - street parking may be provided on a site other than the building
22 site on condition that an agreement between the property owner and
23 the City is executed and recorded providing that the off- street
24 parking shall be provided and maintained on a designated parcel of
25 land for the duration of the proposed use or uses on the building
26 site or sites; and
27 WHEREAS, a new contract has been prepared under which it
28 is agreed that said off -site parking will be provided and maintainer
29 NOW, THEREFORE, BE IT RESOLVED that the City Council
30 hereby approves said agreement and the Mayor and City Clerk are
31 authorized and directed to execute the same on behalf of the
32 City.
1 BE IT FURTHER RESOLVED that Resolution No. 5510 is
2 hereby rescinded.
3 BE IT FURTHER RESOLVED that the City Clerk is authorized
4 and directed to record said agreement and execute any certificate
5 necessary to accomplish said recording.

the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
