RESOLUTION NO.`S
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
QUITCLAIM .
WHEREAS, the City of Newport Beach acquired a surface
easement over portions of Lots 269 40, and 41, in Tract No. 3138, i
in the City of Newport Beach, County of Orange, State of California;
as shown on a map recorded in Book 103, page 31, of Miscellaneous
Maps, Records of said County, by grant of easement recorded in Book
5204, page 529, of Official Records of said County; and
WHEREAS, the City has subsequently acquired easements in
lieu of said surface easement; and
WHEREAS, a flood control conduit and appurtenant struc-o
tures have been constructed in accordance with such easements; and
WHEREAS, the City has no present or prospective need for
said surface easement;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
Clerk be and are hereby authorized to execute a quitclaim on behalf
of the City of Newport Beach releasing said surface easement to the
owner or owners of record of said Lots 26, 40, and 41, excepting,
however, from said quitclaim any easements or interests acquired in
or to said lots by virtue of the recording of said tract map, the
grant of easement to the City recorded in Book 5905, page 273, of
said Official Records, the grant of easement to the City recorded
in Book 5886, page 68, of said Official Records, or the eminent
domain action entitled City of Newport Beach v. Courtney C. Platt,
et al, being Superior Court No. 101095, the final order of which is
recorded in Book 6102, page 693, of said Official Records.
