RESOLUTION NO. 5602
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH GRANTING A PERMIT TO PROVIDE PUBLIC
TRANSPORTATION IN THE BALBOA BUSINESS DISTRICT
GJkIEREAS, the Balboa Pavilion Company is operating the
Balboa Pavilion at the intersection of Main Street and Edgewater
Avenue in the Balboa business district, and
WHEREAS, said company has requested authorization to
provide public transportation from the Balboa Municipal Parking
Lot through the Balboa business district to said Pavilion without
charge to the passengers; and
WHEREAS, it appears that it would be in the best inter-
ests of all businesses in the Balboa area and in the public interest
for said service to be provided;
NOZJ, THEREFORE, BE IT RESOLVED that such authorization is
hereby granted, subject to the following conditions.
1. The vehicle used shall be a licensed rotor vehicle
which meets all the requirements of the California Vehicle Code and
shall be maintained in a clean and safe condition.
2. Passengers will be transported from the Balboa Park
Lot to the Balboa business district without charge and without any
limitation on the destination of such passengers in the business
district.
3. The vehicle and all equipment used in connection
�Itherewith shall be subject to inspection and approval by the Police
Department.
4. All drivers shall be subject to check and approval
by the Police Department.
5. This permit is nontransferable and nonexclusive and
is subject to revocation by the City Council without notice.
6. The route shall be from the Balboa Municipal Parking
Lot easterly to Main Street, northerly on Main Street to Edgewater

Avenue, easterly on Edgewater Avenue to A Street, southerly on A
Street to the A Street Parking Lot, and thence westerly to the
Balboa Municipal Parking Log; provided, however, that the City
Manager may authorize variations in this route as traffic condi
and need for the service vary.
7. The permittee construct, in accordance with plans
and specifications approved by the Director of Public Works, a
surfaced roadway leading from the A Street Parking Lot westerly to
the Balboa Municipal Parking Lot.
8. The permittee maintain liability insurance naming
the City as an additional insured in an amount satisfactory to
the City Manager and City Attorney. A certificate of insurance
must be filed with the City providing that the insurance will not
be cancelled or the amount of coverage reduced without ten days'
written notice to the City.
BE IT FURTHER RESOLVED that the permittee may operate
during such hours as it deems necessary; provided, however, that
the City may designate minimum or maximum hours during which such
operation must be maintained.
