RESOLUTION N0. 5614
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF
COVENANTS, CONDITIONS, AND RESTRICTIONS BEING
IMPOSED UPON TRACT N0. 4692
WHEREAS, there has been presented to the City Council of
the City of Newport Beach by John B, Kilroy and Rejac Corp., sub-
dividers of Tract No. 4692, a document entitled "Declaration of
Covenants, Conditions and Restrictions ", whereby covenants, condi-
tions, and restrictions are imposed upon all lots in Tract No.
4692 as covenants running with the land; and
WHEREAS, John B. Kilroy and Rejac Corp. are the owners of
all lots in Tract No. 4692 and propose to impose said Declaration
of Covenants, Conditions and Restrictions upon said tract for the
benefit of all of the lots therein and for the benefit of the
adjoining land owned by the City; and
WHEREAS, the City of Newport Beach is the owner in fee of
the land within Tract No. 4692 dedicated for street purposes; and
EMI REAS, the City Council has reviewed said document and
determined that it adequately provides for the permanent upkeep,
maintenance, and payment of taxes of Lot 99 of Tract No. 46922 as
required by Section 9256.13 of the Newport Beach Municipal Code-*
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
Clerk be and are hereby authorized and directed to execute the
same on belslf of the City of Newport Beach.
