RESOLUTION NO. it 7
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ACCEPTING A GRANT OF EASEMENT
WHEREAS, The Irvine Company, a West Virginia corporation,
has executed a grant of easement granting to the City of Newport
Beach a non - exclusive easement for the construction, reconstruction,
maintenance and repair of an underground pipeline for drainage pur-
poses in and along a strip of land, 6.00 feet in width, situated in
the City of Newport Beach, County of Orange, State of California,
described,as follows:

That portion of lot 165, block 53 of Irvine °s Subdivision
as shown on a map recorded in Book 1, page 88 of Miscel-
laneous Record Maps, in the office of the county recorder
of Orange County, California, the southwesterly line of said
strip being described as follows:
Beginning at the most southerly corner of lot 91, Tract No.
4224 as shown on a map recorded in Book 157, pages 1 to 14
inclusive, of Miscellaneous Maps; thence South 54° 30° 00"
East 26.00 feet; thence South 22° 03° 30 10 East 82.65 feet.
to an intersection with the northwesterly -line of Newport
Bay as shown on said map.
The northeasterly line of said 6.00 foot wide strip to be
shortened or lengthened, as the case may be, so as to
originate in the southeasterly line of said lot 91 and
terminate in said northwesterly line of Newport Bay;
WHEREAS, said grant of easement also recites as follows:
"RESERVING unto the Grantor, its successors and assigns,
the right to use said land for any purpose whatsoever as
shall not interfere with the use of said easement by the
Grantee, including but not limited to the right to construct,
relocate, repair and maintain driveways, surfaced areas,
docks, slips and sidewalks; provided however no building
shall be erected on said easement.
ALSO RESERVING unto the Grantor, its successors and as-
signs, the right to change the location of said easement
upon the condition that the Grantor grants to the Grantee
herein an easement at another location for a storm drain of
Aft, adequate capacity upon the terms and conditions herein set
qW forth, and that the Grantor, its successors or assigns,
reconstructs or reimburses the Grantee for the cost of re-
construction of the pipeline installed within said easement
and its appurtenances in a manner that will continue the
usefulness and efficiency of said pipeline."
and
WHEREAS, it is to the interest of the City to accept said
grant of easement for such purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said grant of easement be accepted

and the City
Clerk is authorized
and directed
to execute
and
attach
a certificate
of acceptance and
consent to the
recording
of
said
grant of easement in the County Recorder's office.
ADOPTED this 11th day of September, 1962.
