HomeMy WebLinkAbout5671 - Bayside Drive Vacation912:/62 (12) 1ESOLUTIO1,4 NO. -"( i / 1 A RESOLUTION OF INTLNTicN OF THE CITY COUNCIL 2 OF THE CITY OF It WPORT BEACH DZCLARING ITS INTENTION TO ORDER THE CLOSING UP, VACATION 3 AND ABAIJDDONIZUP OF A PORTION OF BAYSIDE DRIVE- 4 The City Council of the City of Newport Beach, pursuant 5 to the provisions of the "Street Vacation Act of 1941 ", and all 6 amendments thereto, being Sections 8300 to 8331, inclusive, of the 7 Streets and Highways Code of the State of California, does hereby 8 resolve and declare as follows; 9 SECTION 1. The public interest and convenience require 10 the closing up,rvacation and abandonment of a portion of a certain 11 street known as Bayside Drive in the City of Newport Beach, and it 12 is the intention of the City Council of the City of Newport Beach 13 to order the following described portion of said street in the 14 City of Newport Beach, County of Orange, State of California, to 15 be vacated, closed up and abandoned, to wit: 16 68That portion of land in the County of Orange, 17 State of California, described in the deed to the County of Orange, recorded March 15, 1957, in 18 Book 3839, Page 88, of Official Records, in.-the Office of the County Recorder of Orange County, 19 California, 20 EXCEPT that portion thereof lying westerly of a line between Stations 16A and 16B of the Ordinary High 21 Tide Line established in 1926 by Court Decree No. 20436 -.of The Superior Court of Orange County, 22 ALSO EICCEPT that portion thereof lying northerly 23 of, the westerly line of the 80 -foot wide Bayside Drive Road right of way as recorded in Book 4288, Page 216 of Official Records in the office of said 24 Orange County Recorder," 25 All of said street to be vacated, closed up and abandoned • 26 is more clearly shown on a certain map approved and adopted by the 27 City Council of the City of Newport Beach for said vacation, closing 28 up and abandonment, by resolution dated September 24, 1962, and 29 designated B7Resolution No. 5'(,7o 49, which said map is on file in 30 the office of the City Clerk of the City of Newport Beach. SECTION 2. The proceedings for the closing up and of the aforesaid portion of said street shall be had and taken, the City Council of the City of Newport Beach hereby elects to eed under the provisions of the "Street Vacation Act of 1941t°, all amendments thereto, being Sections 8300 to 8331, inclusive, of the Streets "and highways Code of the State of California. SECTION 3. The Street Superintendent of the City of Newport Beach shall cause to be conspicuously posted along the Dine o: the street proposed to be vacated not more than 300 feet apart, but less than three in all, notices of the vacation of said street. Said notices shall state the passage of this Resolution of Intention and the time and place of the heasigg of all persons interested in or objecting to the proposed vacation of said street. Said notices shall be so posted at least ten days before the date of said hearing, all as required by law. SECTION 4. Notice is hereby given that the City Council of the City of Newport Beach does hereby fix , the % 3 td, day of Gets er-j 1962, at the hour of 7:30 P. M., of said day, in the Council Chambers at the City of Newport Beach, located in the �L City Hall of the City of Newport Beach, as the time and place for hearing all persons interested in or objecting to the proposed vacation of said portion of said street, and the City Council at said time and place will hear the evidence offered by any person interested in the vacation of said portion of said street herein- before described. SECTION 5. This Resolution of Intention shall be publish at least once in the official newspaper of the City, and said publication shall be made before the date set for the hearing of all persons. interested in or objecting to the proposed vacation.
