HomeMy WebLinkAbout5678 - Change Alley GradesRESOLUTION N0. -O�6 Zf A RESOLUTION OF INTENTION OF THE CITY COUNCIL • OF THE CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO ORDER A CHANGE IN THE OFFICIAL GRADE OF PORTIONS OF CERTAIN ALLEYS, The City Council of the City of Newport Beach, pursuant to the provisions of the "Change of Grade Act of 1909 ", and all amendments thereto, being Sections 8000 through 8062, inclusive, of the Streets and Highways Code of the State of California, does hereby resolve and declare as follows: SECTION 1, The Public interest and convenience require that the official grades of portions of certain alleys in the City of Newport Beach be changed and it is the intention of the City Council of the City of Newport Beach to order the following changes of grades, to wit: (a) The official grade of the first alley easterly of Island Avenue (formerly 1st Street) from the northerly line of Ocean Front (formerly Surf Avenue) to the southerly line of Balboa Boulevard (formerly Central Avenue) is hereby established in accordance with the following elevations: At the northwesterly comer of Ocean Front (formerly Surf Ave.) At the northeasterly corner of Ocean Front (formerly Surf Ave.) At a point one foot northerly of the southeasterly corner of Lot 13, Block 11, East Newport Tract At a point nine feet southerly of the northwesterly corner of Lot 16, Block 11, East Newport Tract At the northwesterly corner of Lot 16, Block 11, East Newport Tract At the southwesterly corner of Lot 10, Block 11, East Newport Tract At a point ten feet southerly of the northeasterly corner of Lot 13, Block 11, East Newport Tract At the southwesterly corner of Balboa Boulevard (formerly Central Avenue) At the southeasterly corner of Balboa Boulevard (formerly Central Avenue) 10.20 feet 10.20 feet 9.50 feet 9.54 feet 9.52 feet 9.36 feet 9.36 feet 8.30 feet 8.26 feet (b) The official grade of the alley running easterly and westerly through Block 1 and 3 of the Newport Bay Tract and Block 11 of • East Newport, and extending from the alley easterly of Block 2 of the Newport Bay Tract to the alley running northerly and southerly through Block 11 of East Newport, is proposed to be changed to the following elevations: At the northwesterly corner of Alvarado Street 9.06 feet At the southwesterly corner of Alvarado Street 9.06 feet At a point ten feet westerly of the northeasterly corner of Lot 22, Block 11, East Newport Tract 9.63 feet At a point ten feet westerly of the northeasterly corner of Lot 17, Block 11, East Newport Tract 9.91 feet At a point ten feet westerly of the southeasterly corner of Lot 9, Block 11, East Newport Tract At the northeasterly corner of the alley running northerly and southerly through Block 11, East Newport Tract • At the southeasterly corner of the alley running northerly and southerly through Block 11, 9.91 feet 9.36 feet 9.52 feet All those portions of said alleys whose official grades are proposed to be changed are more clearly shown on a certain map adopted and approved by the City Council of the City of Newport Beach for said changes in grade, by Resolution dated 2,a 'l , 1962 and designated Resolution No. .1-6 7 :� which said map is on file in the office of the City Clerk of the City of Newport Beach. Reference is hereby made to said map for further particulars as to the proposed changes in official grades, and said map is made a part of this Resolution by reference to the same extent and purpose as if it were incorporated herein in full. SECTION 2. Datum Plane. All grades referred to in Section 1 of this Resolution of Intention are based on the sea level datum of 1929, as established by the United States Coast and Geodetic Survey; said datum plane being the official datum plane of the City of Newport Beach as provided by Ordinance No. 994, adopted April 9,1962, and codified as Section 7150 of the Newport Beach Municipal Code. SECTION 3. The proceedings for the changes in official grades of the aforesaid portions of certain alleys shall be had and taken, and the City Council elects to proceed under the provisions of the "Change of Grade Act of 1909 ", and all amendments thereto, being Sections 8000 through 8062, inclusive, of the Streets and Highways Code of the State of California. SECTION 4. The City Clerk of the City of Newport Beach shall cause this Resolution of Intention to be posted conspicuously on or near the chamber door of the City Council, and to cause the same to be published for two successive weeks in the official newspaper. SECTION 5. The Street Superintendant of the City of Newport Beach shall cause a notice of the passage of this Resolution of Intention to be conspicuously posted along all alleys or portions thereof designated herein, where such change of grade is proposed to be made, at not more than 100 feet in distance apart, but not less than 3 notices in all. The Street Superintendant shall also cause said notice to be published for two successive weeks in the official newspaper. 2. SECTION 6. Notice is given that pursuant to section 8040 of the Streets and Highways Code of the State of California, any person • owning any real property fronting on any portion of the aforesaid alleys on which such changes of grades are proposed to be made, may, within 30 days after the first publication of the notice of passage of this Resolution of Intention is made, file with the City Clerk written protests against such proposed changes of grades.
