RESOLUTION NO. 5691
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH# CALIFORNIA# MAKING FINDINGS ON
PETITION AND WAIVER _(RIVER AVENUE# ALLEY AND
CERTAIN OTHER STREETS AND EASEMENTS),
WHEREAS` there has been presented to the City Council
a Petition signed by certain property owners requesting certain
improvements in River Avenues Alley and certain other streets
and easements in said Cityf and
WHEREAS,, said Petition contains a waiver of the
provisions of the "Special Assessment Investigation,, Limitation
and Majority Protest Act of 1931 ", as provided for in Section 2804
of said Actl and
WHEREAS,, it is certified to this Council that said
Petition and waiver contains the signatures of all of the owners
of more than 60% in area of the property to be subject to assess-
ment for said proposed improvement.
NOW# THEREFORE# THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH,, CALIFORNIA, DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council finds that said
Petition and waiver has been signed by all of the owners of more
than 60% in area of the property to be subject to assessment for
the improvement requested in said Petitions and meets the require-
ments of Section 2804 of Division 4 of the Streets and Highways
Code of the State of California.
SECTION 2. That said Petition and waiver be filed in
the office of the City Clerk of the City of Newport Beach,
California.
APPROVED and ADOPTED this ?s66th day of November, 1962.

Newport Beach, California, DO HEREBY CERTIFY that the foregoing
Resolution, being Resolution No. 5691 was duly passed,
approved and adopted by said City Council, approved and signed
by the Mayor, and attested by the City Clerk, all at a regular
meeting of said City Council held on the 26th day of
November, 1962, and that the same was passed and adopted by
the following vote, to wit:
AYES: COUNCILMEN Stoddard, Gruber, Cook, Hart,
Lorenz, Marshall, Elder
NOES: COUNCILMEN None
ABSENT COUNCILMEN None
