RESOLUTION NO. 5697
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF AGREE-
MENTS WITH FRANK.THARP_FOR 14AINTENANCE OF TRAFFIC
SIGNAL EQUIPNE-NT
WHEREAS, there has been presented to the City Council of
the City of Newport Beach an agreement between the City of Newport
Beach and Franc Tharp, doing business as Traffic Signal Maintenance
Company, as contractor, for the maintenance of the traffic signal
equipment owned and operated by the City for a period of five years
beginning on the date of said agreement; and
WHEREAS, under said agreement the contractor agrees to
furnish a surety bond or cash deposit in the amount of $1,000 to
guarantee the faithful performance thereof; and
WHEREAS, there has also been presented to the City
Council an agreement under which said contractor assigns and trans-
fers Investment Account Certificate No. 5079 of Newport Balboa
Savings and Loan Association in the amount of $1,000 to the City
of Newport Beach to guarantee faithful performance of said main-
tenance agreement; and
WHEREAS, the City Council has considered the terms and
conditions of said agreements and found them to be reasonable and
equitable;
NOW, THEREFORE, BE IT RESOLVED that said maintenance
agreement and said agreement for deposit of cash to insure the
faithful performance thereof be approved and the Mayor and City
Clerk are hereby authorized and directed to execute the sane on
behalf of the City of Newport Beach.
