RESOLUTION NO. P1 3 G
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ORDERING A CHANGE IN THE OFFICIAL
GRADE OF PORTIONS OF CERTAIN ALLEYS
WHEREAS, the City Council of the City of Newport Beach
did, on the 8th day of October, 1962, pass its certain Resolution j
of Intention No. 14638, declaring its intention to order a charge in
the official grade of portions of certain alleys in Block 11. of
East Newport Tract in the City of Newport Beach, hereinafter more
particularly described, pursuant to and in accordance with the pro-
visions of the "Utange of Grade Act of 1939S°, and all amenemaents
thereto, being Sections 8000 through 8062, inclusive, of the Streets
and. Highways Code of the State of California; and
MMREAS, the City Clerk of the City of Newport Beach
caused said resolution of intention to be posted conspicuously for
two days on or near the clgmber door of the City Council, all of
which will more fully appear from the affidavit of Margery Sc.scouderl
City Clerk of the City of Newport Beach, on file in these proceed- l
ings; aaid
TMEREAS, the Street Superintendent of the City of Newport
Beach caused copies of a notice of the passage of said resolution
of intention to be conspicuously posted along all alleys or portions
thereof designated therein where such changes of grade are proposed
to be made, at not more than 100 feet in distance apart, but not
less than three notices in all, all of which will more fully appear i
from the affidavit of Donald C. Simpson, Street Superintendent of
the City of Newport Beach, on file in these proceedings; and'
S. said resolution of intention and said notice of
the passage of said resolution of intention have each been pub-
lished by two insertions in the Newport Harbor Ensign, a weekly
newspaper published and circulated in the City and designated by
the Council for that purpose, all of which will more fully appear.

from the affidavits of Arvo E. Haapa, owner and publisher of said
Newport harbor Ensign, on file in these proceedings; and
WHEREAS, said notices so posted by the Street Seperinten-
dent of the City of Newport Beach were headed "Notice of Change of
Grade" in letters of not less than one inch in height, and in
legible characters stated the fact of the passage of said resolu-
tion of intention, its date, and the name or other designation of
the alleys or portions thereof the grade of which is proposed to
be changed, and referred to the resolution of intention for further
particulars; and
WHEREAS, no written protests against such proposed change
of grade were filed within 30 days after the first publication of
the notice of the passage of the resolution of intention by any
person owning any real property fronting upon any alley or portion
thereof on which such changes of grade are proposed; and
WHEREAS, the City Council has acquired jurisdiction to
order to be made the changes of grade as proposed by and described
in said resolution of intention;
NOW, THEREF0RE, the City Council of the City of Newport
Beach hereby orders changes of the official grade of certain alleys
in Block 11, East Newport `tract, as said East Newport Tract is
shown upon a map recorded in map book 3, page 37, records of Orange
County, California, as follows:
1. The official grade of the first alley easterly of
Island Avenue (formerly 1st Street) from the northerly line of
Ocean Front (formerly Surf Avenue) to the southerly line of Balboa
Boulevard ( formerly Central Avenue) is hereby established in
accordance with the following elevations:
fit the northwesterly corner of Ocean Front
(fo merly Surf Ave. ) 10.20 feet
At the northeasterly corner of Ocean Front
(formerly Surf €sve.) 10.20 feet
At a point one foot northerly of the south-
easterly corner of Lot 13, Block 11, East
Newport Tract 9.50 feet

2. The official grade of the alley running easterly and
westerly through said Block 11 from the westerly line of Alvarado
Street to the easterly line of the alley described in paragraph 1
above is hereby established in accordance with the following eleva-
tions:
At the northwesterly corner of Alvarado
Street 9.06 feet
At the southwesterly corner of Alvarado
Street 9.06 feet
At a point ten feet westerly of the north-
easterly corner of Lot 22, Block 11, East
Newport Tract 9.63 feet
At a point ten feet westerly of the north-
easterly corner of Lot 17, Block 11, East
Newport Tract 9.91 feet
At a point ten feet westerly of the south-
easterly corner of Lot 9, Block 11, East
Newport Tract 9.91 feet
At the northeasterly corner of the alley
running northerly and southerly through
Block 11, East Newport Tract 9.36 feet
At the southeasterly corner of the alley
running northerly and southerly through
Block 11, East Newport Tract 9.52 feet
3. All grades hereby established are based on the sea
level datum of 1929, as established by the United States Coast and
Geodetic Survey, said datum plane being the official datum plane of

I the City of Newport Beach as provided by Ordinance No. 994, adopt
2 April 9, 1962, and codified as Section 7150 of the Newport Beach
3 Municipal Code.
4 The City Council further resolves and orders that this
5 resolution shall be published at least once in the official news-
6 paper of the City.
