RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS INTENTION TO ANNEX TO
THE CITY CERTAIN PROPERTY KNOWN AS ANNEXATION NO.
55 AND GIVING NOTICE THEREOF
WHEREAS, there is situated outside and contiguous to the
City of Newport Beach a certain uninhabited territory within the
meaning of the Annexation of Uninhabited Territory Act of 1939,
said territory being hereinafter more particularly described; and
WHEREAS, the City has received a written petition request-
ing annexation of said territory containing a description thereof
and signed by the owners of not less than one - fourth of the land in
said territory by area and by assessed value as shown on the last
equalized assessment roll of the County; and
WHEREAS, on or about the 4th day of September, 1963, there
was submitted to the Secretary of the Orange County Boundary Com-
mission a legal description and plat of the hereinafter described
uninhabited territory for its report, and said plat was filed with
the Registrar of Voters, pursuant to the provisions of Section
35002 of the Government Code of the State of California; and
WHEREAS, on the 23rd day of September, 1963, there was
filed with the City Clerk of the City of Newport Beach a report
of said Orange County Boundary Commission prepared pursuant to the
provisions of Section 35002 of said Government Code; and
WHEREAS, the petitioner is the owner of all of the ter-
ritory to be annexed and by its petition consents to such annexa-
tion;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that proceedings are hereby initiated

to annex said
territory hereinafter
described, which
territory is
contiguous to
the present boundaries
of said City and
which said
territory now is uninhabited within the meaning of the Annexation
of Uninhabited Territory Act of 1939 and that the reasons for
said annexation are that the owner of all of said property has
petitioned for its annexation to the City of Newport Beach and it
would make municipal services available to said property owner
and be in the best interests of said owner and the City and its
citizens that said City annex said territory.
NOTICE IS HEREBY GIVEN that it is proposed by said City
of Newport Beach to annex said hereinafter described territory to
said City, which said territory shall in these proceedings bear the
name of "ANNEXATION NO. 55 ". The specific description of the bound-
aries of the territory so proposed to be annexed is as follows:
Portion of Lot D, Banning Tract, Superior Court Case
6385, Los Angeles County, California;, portion of Lot 1,
Tract 463, as shown on a Map thereof, Recorded in Book
32, pages 2 and 3 of Miscellaneous Maps, Records of
Orange County, California, and a portion of Lot 1,
Tract 2250, as shown on a Map thereof, Recorded in Book
104, pages 6 and 7 of Miscellaneous Maps, Records of
said Orange County, more particularly described as
follows-
Beginning at the intersection of the Northwesterly prolon-
gation of the center line of Balboa Boulevard with the
Southeasterly prolongation of the center line of the
California State Highway ORA, 60 -A, as shown on a Map of
Tract No. 3162, Recorded in Book 95, pages 16, 17 and 18
inclusive, of Miscellaneous Maps, Records of said Orange
County; thence North 54° 10' 15" West along the said
Southerly prolongation and along the center line of said
California State Highway, a distance of 509.48 feet to the
beginning of a tangent curve concave Southwesterly and
having a radius of 1000.00 feet; thence North 35 49' 45"
East along a line measured at right angles to the last
mentioned course, a distance of 50.00 feet to the boundary
line of the City of Newport Beach, established by "The
Five Parcel Annexation ", Annexed to said City by Ordinance
No. 683; thence South 54° 10' 15" East along said Bound-
ary line, a distance of 96.98 feet to the True Point of
Beginning of this description; thence departing from
said Boundary line North 0° 38' 10" West, 621.72 feet;
thence South 54° 10' 15" East, 659.54 feet to the begin-
ning of a tangent curve concave Northeasterly and having
a radius of 450.00 feet; thence Southeasterly along said
curve through an angle of 4° 08' 51 ", a distance of 32.57
feet; thence South 84° 49' 47" East, 575.70 feet to the
most Northerly corner of the land described in a Deed to
A. E. S. Chaffey et al, Recorded in Book 4228, page 191
of Official Records of said Orange County; thence South
39° 41' 15" West, along the Northwesterly line of the
said land described to A. E. S. Chaffey et al, a distance
of 75.42 feet to the beginning of a tangent curve concave
Northwesterly and having a radius of 450.00 feet; thence
Southwesterly along said curve and along the said North-
westerly line, a distance of 235.10 feet; thence South
5° 46' 58" East, along the Southwesterly line of said
land described to A. E. S. Chaffey et al, a distance of
234.53 feet to a point in the Northwesterly line of the
Right of Way for Superior Avenue as described in a Deed,
Recorded January 4, 1954, in Book 2643, page 218 and
Recorded March 22, 1954 in Book 2692, page 622 of Official
Records of said Orange County, said point being the begin-
ning of a non - tangent curve concave Northerly and having

a radius of 343.48 feet, a radial line from said point
bears North 1° 25' 15" East; thence Westerly along said
curve and along the said Northwesterly Right of Way line
through an angle of 15° 40' 15 ", a distance of 93.94 feet
to a line tangent; thence North 720 54' 30" West, along
the said Northwesterly Right of Way line and along said
line tangent, a distance of 281.95 feet to the beginning
of a tangent curve concave Southerly and having a radius
of 290.00 feet; thence Southwesterly along said curve
and along said Northwesterly line'through an angle of
540 07' 43 ", a distance of 273.98 feet to a point in the
said boundary line of the City of Newport Beach, said
point being on a curve concave Northeasterly and having
a radius of 950.00 feet; thence Northwesterly along said
curve and along said boundary line through an angle of
40 08' 51 ", a distance of 68.77 feet to a line tangent,
said line tangent being parallel with and 50.00 feet North -
easterly of, the said centerline of the California State
Highway; thence North 54° 10' 15" West, along the said
line tangent and along the said boundary line, a distance
of 290.03 feet to the True Point of Beginning of this
description.
FURTHER NOTICE IS HEREBY GIVEN that on Monday, the 28th
day of October, 1963, at the hour of 7030 P. M. on said day, or
as soon thereafter as the matter may be heard, in the Council
Chamber of the City Hall of the City of Newport Beach, 3300 Newport
Boulevard, Newport Beach, California, a hearing will be had, at
which hearing the City Council shall hear and pass upon all written
protests filed at any time prior to the final adjournment of the
hearing by any person owning real property within the territory pro-
posed to be annexed, and at any time prior to said final adjournment
any owner of property within the territory proposed to be annexed
may file a written protest against the annexation. The protest
shall set forth the name of the owner of the property affected and
give a description of the said property in general terms.
The City Clerk of the City of Newport Beach is hereby
authorized and directed to cause a copy of this resolution to be
published once a week for two weeks, said publication to be com-
plete at least twenty (20) days prior to the date set for the hear-
ing, and the publication shall be in the official newspaper of the
City.
The City Clerk is further authorized and directed to
transmit a certified copy of this resolution to the governing

board of each school district which is included in whole or in
part within the territory proposed to be annexed which has made
written request therefor.
