2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NORT BEACH AUTHORIZING THE EXECUTION OF
3 COVENANTS, CONDITIONS,.AND RESTRICTIONS BRING
IAas OSED. UPON TRACT NO. 5463

5 WHEREAS, there has been presented to the City Council of
6 the City of Newport Beach by The Irvine Company, a West Virginia
7 corporation, as owner, and The Bluffs, a limited partnership, as
8 its lessee and subdivider of Tract No. 5463, a document entitled
9 "Declaration of Covenants, Conditions and Restrictions ", whereby
10 covenants, conditions, and restrictions are imposed upon all lots
11 in Tract No. 5463 as covenants running with the land; and
12 ir7IlMEAS, The Irvine Company is the owner and The Bluffs
13 is the lessee of all lots in Tract No. 5463 and propose to impose
14 said Declaration of Covenants, Conditions and Restrictions upon
15 said tract for the benefit of all of the lots therein and for the
16 benefit of the adjoining land owned by the City; and
17 tMEEREAS, the City of Newport Beach is the owner in fee of!
18 the land within Tract No. 5463 dedicated for street purposes; and
19 WHEREAS, the City Council has reviewed said document and
20 determined that it adequately provides for the permanent upkeep,
21 maintenance, and payment of taxes of Dot 14 of Tract No. 5463, as
22 required by Section 9256.13 of the Newport Beach Municipal Code;
23 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
24 Clerk be and are hereby authorized and directed to execute the
25 same on behalf of the City of Newport Beach,
26 ADOPTED this 10th day of February, 1964.
