3 TERRITORY FOR TRACT NO. 5740 UNDER T19 DECLARATION
OF COVENANTS, CONDITIONS AND RESTRICTIONS APPLICABLE
4 TO TRACTS NOS. 5463 AND 5480 AND AUTHORIZING TTL

71 91- MMAS, the City of Newport Beach has previously
8I executed Covenants. Conditions and Restrictions applicable to
9 Tract No. 5463 and Tract No. 5480 pursuant to Resolution No, 5925;

ill M- 1EREAS, a final subdivision map has been approved for
12 Tract No. 5740 which adjoins said tracts; and
13 WIMEAS, said Tract No. 5740 is a portion of the planned
14 residential development approved by Use Permit No. 1054(8); and
15 "MREAS, Declarant has submitted to the City a "Notice of
16 Addition of Territory" in connection with Tract No. 5740 Tahich will
17 subject said tract to the Declaration of Covenants, Conditions and
18 Restrictions previously recorded for Tract No. 5463 and Tract No.
19 5430; and
20 TtiMEREAS, said Covenants, Conditions and .Restrictions
21 provide for the approval of the City to be endorsed on said notice;
22 NOBS, THE dFORE, BE IT RESOLVED that the Notice of Addi-
23 tion of Territory is approved by the City, and the Mayor and City
24 Clerk are authorized and directed to execute said notice on behalf
251J of the City.
