HomeMy WebLinkAbout6073 - Tracts 4705 4892 4893 5018S 1 -• 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 s � LIP- 64 (12) xasdr9aacnt Noo 22957 Book, 7:59 RESOLUTION NO. 2:373 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE VACATION OF CERTAIN WALIgaAY AND PUBLIC UTILITY EASEMENTS IN TRACTS 4705,, 4892, 4893 and 5018 WHEREAS, the City Council of the City of Newport Beach did, on the 9th day of November, 1964, pass its certain Resolution of Intention No. 6063, declaring its intention to order the vacatic of certain walkway and public utility easements in the City of Newport Beach, hereinafter more particularly described, pursuant to and in accordance with the "Public Service Easements Vacation La and all amendments thereto, being Sections 50430 to 50445, inclusia of the Government Code of the State of California; and TUBEREAS, the Public Works Director of the City of Beach has caused to be conspicuously posted along the linesof said easements proposed to be vacated, not more than 300 feet apart and not less than three in all, notices of the vacation of said ease- ments, and said notices were posted at least ten days before the date of the hearing of all persons interested in or objecting to the proposed vacation, all of which will more fully appear from the affidavit of Joseph T. Devlin, Public Works Director of the City of Newport Beach, on file in these proceedings; and WHEREAS, said notices so posted by the Public Works Director of the City of Newport Beach stated the passage of said Resolution of Intention No. 6063 aforesaid, and the time and place of the hearing before the City Council of all persons interested or objecting to the proposed vacation of said easements; and [AREAS, the City Council of the City of Newport Beach did set Mondays December 14, 1964, at 7:30 otclock P. M. on said day as the time, and the Council Chamber located in the City Hall of the City of Newport Beach at 3300 Newport Boulevard, Newport Beach, California, as the place, for hearing all persons interest in.or objecting to the proposed vacation of said easements; and 0 • 0 1 2 3 4 5 6 7 8 9 10 11 12' 131 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 iMREAS, a notice of said hearing, giving the date, time and place thereof, was published in the official newspaper of the City once each week for at least two successive weeks prior to hearing, all of which will more fully appear by the affidavit of William M. Schmidt, Advertising Manager of the Newport Harbor News Press -Daily Pilot, said official newspaper, on file in these pro- ceedings; and WHEREAS, the City Council of the City of Newport Beach has heard the evidence, both written and verbal, of all persons interested in the vacation of said easements in this resolution more particularly hereinafter described, and finds from all the evidence submitted that said easements described in said Resolu of Intention, and hereinafter described, are unnecessary for pr or prospective public use; NOW, TH=EFORE, the City Council of the City of Newport Beach finds and determines and hereby orders that those certain walkway and public utility easements described as follows: Easement No. 1 An easement 6 feet in width to the City of Newport Beach, for walkway and public utility purposes, over.the easterly 3 feet of Lot 56, Tract 4705, and over the westerly 3 feet of Lot 57, Tract 4705, in said City of Newport Beach, County of Orange, State of California, as shown on a map recorded in Book 186, Pages 31 through 35 inclusive of Miscellaneous Maps in the office of the County Recorder of said County. Easement No. 2 An easement for walkway purposes, 10 feet in width, over the northerly and easterly 10 feet of Lot 54, Tract 4892, in the City of Newport Beach, County of Orange, State of California, as shown on a map recorded in Book 180, pages 24, 25, and 26 of Miscellaneous Maps in the office of the County Recorder of said County. Easement No. 3 A Walkway Easement, 6 feet in width, over the southerly and easterly 6 feet of Lot 46, Tract 4893, in the City of Newport Beach, County of Orange, State of California, as shown on a map recorded in Book 180, Pages 20 through 23 inclusive of Miscellaneous Maps in the office of the County Recorder of said County. 2. 1 Easement No. 4 2 An easement for walkway and public utility purposes, 6 feet in width, over the southeasterly 6 feet of 3 Lot 66, Tract 5018, in the City of Newport Beach, County of Orange, State of California, as shown on a 4, map recorded in Book 186, Pages 26 through 30, inclusive, of Miscellaneous Maps in the office of 5 the County Recorder of said County; 6 are unnecessary for present or prospective public use, and that th 7� be vacated. 8I The City Council further orders that the vacation of the 9I easement described above as Easement No. 2 is not intended to and 10 shall not be construed to affect or impair that certain easement 11 for storm drain purposes, 10 feet in width, over the northerly and 12 easterly 10 feet of Lot 54, Tract 4892, in the City of Newport 13 Beach, County of Orange, State of California, as shown on a map 14 recorded in Book 180, pages 24, 25, and 26 of Miscellaneous Maps 15 in the office of the County Recorder of said County. 16 The City Council further orders that the City Clerk of 17 the City of Newport Beach shall cause a certified copy of this 18 Order, duly attested by her as the City Clerk, under the seal of 19 the City, to be recorded in the office of the County Recorder of t 20 County of Orange, State of California, immediately following the 21 passage of this resolution. 22 ADOPTED this 14th day of December, 1964. 23 24 Mayor 25 26 ATTEST1 (� i 27 city er 28 29 . 30 31 32 3.
