A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A

QUITCLAIM DEZED

WHEREAS, on the 26th day of August, 1963, the City Council
6
of the City of Newport Beach adopted Resolution No. 5848 authorizing
7
and directing the Mayor and City Clerk to execute a quitclaim deed
8
on behalf of the City of Newport Beach releasing to the owner or
9
owners of record of Lot 13, Block 431, Corona del mar, all
10
of its right, title and interest in and to that certain right of wa3
11
for a sewer pipe line as described in the deed to the City of New -
12
port Beach recorded June 8, 1945, in Book 1316, page 300 of Official
13
Records in the office of the County Recorder of Orange County,
14
California, described as follows;

A parcel of land six (6) feet in width lying three (3)
feet on each side of and adjacent to the following
16
described center line:

Beginning at a point on the Southwesterly line of Lot
13, Block 431 as shown upon the map of Corona del Mar,
18
recorded in Book 3, Pages 41 and 42 of Hiscellaneous
Flap Records of Orange County, California, which point
19
is 51.02 feet Northwesterly from the most Southerly
corner of said Lot 13; thence running North 78° 11' 3099
20
East 38.17 feet to a point in the Northeasterly line of.
said Lot 13, which point is 27.42 feet from the most
21
Easterly corner of said Lot 13; and
22
WHEREAS, said quitclaim deed was never executed on behalf
23
of the City; and
24
WHEREAS, the City of Newport Beach acquired a certain
25
right of way for a sewer pipe line in Lots 13, 15, and 17, Block
26
431, of Corona del Flax, in the City of Newport Beach, County of Orar
27
State of California, as described in the deeds to the City of Newpox
28
Beach recorded June 8, 1945, in Book 1316, page 300, and Book 1320,
29
page 86, of Official Records in the office of the County Recorder

of Orange County, California; and

S, in lieu thereof the City subsequently acquired
32
an easement for sanitary sewer purposes at another location in said
111 Lots 13 and 15, Block 431, Corona del Mar; and
2JI WHEREAS, the City has no facilities in the right of way
3 first granted and has no present or prospective need therefor;
• 4 NOWT THEREFORE, BE IT RESOLVED by the City Council of
5 the City of Newport Beach:
61 1. That Resolution No. 5848 is hereby rescinded.
7 2. That the Mayor and City Clerk are hereby authorized
8 and directed to execute a quitclaim deed on behalf of the City of
9 Newport Beach releasing to the owner or owners of record of Lots
10 132 15, and 17, Block 431, of Corona del Mar, all of its right,
11 title and interest in and to that certain right of way for a sewer
12 pipe line as described in the deeds to the City of Newport Beach
13 recorded June 8, 1945, in Book 1316, page 300, and Book 1320, page
14 86, of Official Records in the office of the County Recorder of
15 Orange County, California, described as follows:
16 A parcel of land six (6) feet in width lying three (3)
feet on each side of and adjacent to the following
17 described center line:
18 Beginning at a point on the Southwesterly line of Lot 13,
Block 431 as shown upon the map of Corona del Mar,
19 recorded in Book 3, ]Page 41 of Miscellaneous Maps,
Records of Orange County, California, which point is
20 51.02 feet Northwesterly from the most Southerly corner
of said Lot 13; thence running North 780 11' 30P° East
21 38.17 feet to a point in the Northeasterly line of
said Lot 13, which point is 27.42 feet from the most
22 Easterly corner of said Lot 13; thence continuing
23 North 780 11' 30f9 East 44.34 feet to a point in the
Southeasterly line of Lot 17 of said Block 431, which
point is 4.85 feet from the most Southerly corner of
24 said Lot 17, Block 431, Corona del Mar,

26 ADOPTED this 22d day of March 1965.
