CALIFORNIA 92701 RESOLUTION NO. 6133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, MAKING A PRE- LIMINARY DETERMINATION THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE CON- STRUCTION OF STREET LIGHTING IMPROVEMENTS AND APPURTENANCES AND APPURTENANT WORK IN PROPOSED "ASSESSMENT DISTRICT NO. 140 11 AND SETTING THE TIME AND PLACE OF HEARING THEREON. THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFOR- NIA, DOES RESOLVE AND ORDER AS FOLLOWS: Section 1: That it is the preliminary determination of said City Coun- cil that the public convenience and necessity require that certain improvements hereinafter described, together with necessary acquisitions thereof, if any, be made and that the cost and expense thereof be paid for by special assessments levied upon the property within the district benefited thereby; and that all necessary proceedings therefor be had and taken without further compliance with the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931. " Section 2: That the following is a description of the proposed work and improvement to be constructed and the proposed acquisition therefor, if any: The installation of an ornamental street lighting system using Marbelite concrete standards, color improved Mercury vapor lamps, and underground electrical .distribution, 'and all other appurtenances and appurtenant work, on Seashore Drive between Summit Street on the west and 33rd Street on the east, and on all of those cross streets located between Balboa Boulevard and Seashore Drive not presently having street lighting, which said cross streets are numbered from 33rd Street to 47th Street, both inclusive. Section 3: That the following is a description of the proposed bound- aries of the proposed "ASSESSMENT DISTRICT NO. 14 ": That portion of land in the City of Newport Beach, County of Orange, State of California, bounded and described as follows: -1- r� U 1 2 3 411 5 6 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 LAW OFFICES OF RINIEL. CALIFORNIA 92701 Beginning at the intersection of the northeasterly line of Sea- shore Drive (40 feet wide) with the westerly boundary line of said City of Newport Beach, as said intersection is shown on a map of Tract 4400, recorded in Book 162, page 20 of Miscel- laneous Maps, Records of said County; thence southeasterly along said northeasterly line of Seashore Drive and following the same through all of its various curves and courses to the most westerly corner of Lot 103, Tract 3813, as per map recorded in Book 162, page 11, of said Miscellaneous Maps; thence north- easterly to the most northerly corner of said Lot 103, said last mentioned corner being in the southwesterly line of Neptune Ave- nue (30 feet wide); thence southeasterly along said southwesterly line of Neptune Avenue to the northwesterly line of 47th Street (30 feet wide) as per map recorded in Book 32, page 50, of Records of Survey of said Orange County; thence northeasterly along said northwesterly line of 47th Street to the southerly line of River Avenue (60 feet wide) as per said last mentioned map; thence easterly along said southerly line of River Avenue to the westerly line of Balboa Boulevard (formerly Bay Avenue, 80 feet wide), as described in a deed recorded August 9, 1927, in Book 70, page 408, of Official Records of said Orange County; thence southerly along said westerly line of Balboa Boulevard to the northwesterly line of Lot 16, Block 45, River Section, as per map recorded in Book 4, page 25, of said Miscellaneous Maps; thence northeasterly to the most northerly corner of said Lot 16, said last mentioned corner being in the southwesterly line of Balboa Boulevard (65 feet wide); thence southeasterly along said last mentioned southwesterly line of Balboa Boulevard (65 feet wide) to the most northerly corner of Lot 13, Block 37, of said River Section; thence southwesterly to the most westerly corner of said Lot 13; thence southeasterly parallel with said last mentioned southwesterly line of Balboa Boulevard to the most southerly corner of Lot 19, Block 36,said River Section; thence northeasterly to the most easterly corner of said Lot 19,said last mentioned. corner being in said last mentioned southwesterly line of Balboa Boulevard; thence southeasterly along the said last mentioned southwesterly line of Balboa Boulevard to the most easterly corner of Lot 17, Block 32, Map of Newport Beach as per map recorded in Book 3, page 26 of said Miscellan- eous Maps; thence southwesterly parallel with the southeasterly line of 33rd Street (30 feet wide) to the northeasterly line of Lot 5, said Block 32; thence northwesterly to the most northerly corner of Lot 6, said Block 32; thence southwesterly along the northwesterly line of said Lot 6 and its southwesterly prolongation to the south- westerly line of Ocean Front (45 feet wide); thence northeasterly along said southwesterly line of Ocean Front, and following the same through all of its various curves and courses to said westerly boundary line of the City of Newport Beach; thence northeasterly along said westerly boundary line to the point of beginning. That reference is also made to a map or plat of said proposed assessment dis- trict on file in the office of the City Clerk of the City of Newport Beach. CALIFORNIA 9 2701 City Council should not find and determine that the public convenience and necessity require said proposed public improvement, with necessary acquisi- tions, if any, hereinabove set forth, without compliance with the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931. 11 Section 5: The City Clerk is hereby directed to give notice of the time and place of said hearing in accordance with the provisions of Section 3 of Resolution No. 6132 heretofore adopted. ADOPTED, SIGNED AND APPROVED this 26th day of April j 1965.
