NMTPORT BEACH APPOINTING AN ENGINEER OF E3®RKb
3 IN CONNECTION WITH ASSESSENT DISTRICT NO. 14 v' '
AND AUTHORIZING THE MIECUTION OF AN AGF'.EMMNT
4 OF MPLOYMENT WITH SUCH ENGINEER OF WORK

6 11t3EREAS, the City Council of the City of Newport Peach
7 intends to initiate proceedings to form an assessment district pur-
8 suant to .the provisions of the Improvement Act of 1911, being
9 Division 7 of the Streets and Highways Code of the State of Cali -
10 fornia, for the purpose of constructing street lighting improvement:
11 and appurtenances in a special assessment district within the City
12 to be known and designated as Assessment District No. 14; and
13 WHEREAS, the Public Works Director of the City of Newport
14 Beach has recommended that an Engineer of Work be appointed and
15 employed to perform all engineering work in connection with said
16 proposed assessment district, and it appears that the firm of
17 Simpson & Stevlingson, a partnership, is qualified for employment
18 as such Engineer of Work and has offered to undertake said work;

20 WHEREAS, there has been presented to the City Council
21 a certain agreement of employment between the City and Simpson &
22 Stevlingson employing said partnership to act as Engineer of Work
23 for said Assessment District No. 14; and
24 14HMUEAS, the City Council has considered the terms and
25 conditions of said agreement and found them to be satisfactory;
26 NOII, THE:REFORE, BE IT RESOLVED:
27 1. That pursuant to the authority granted by Sections
28 5701 and 5702 of the Streets and Highways Code of the State of
29 California, the City does hereby employ Simpson & Stevlingson as
30 Engineer of Mork to perform all the engineering services required it
31 connection with Assessment District No. 14 and the City does hereby
32 designate Donald C. Simpson as the person to make and sign any and

11 all certificates and documents required to be made or signed by the

2 Zngineer of Work for all of the said work and improvements.
31 2. That said agreement be approved and the Mayor and
• 41 City Clerk are hereby authorized and directed to execute the same
5i on behalf of the City of Newport Beach.
