A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NM-TPORT BEACH DECLARING ITS INTENTION. TO AN=,_

/ TO THE CITY CERTAIN PROPERTY KNOWN.AS ANNEXATION
NOHER57 (CENTERVIEU ANNEXATION) AND GIVING NOTICE

WHEREAS, there is situated outside and contiguous to the
7
City of Newport Beach a certain uninhabited territory within the
8
meaning of the Annexation of Uninhabited Territory Act of 1939,
9
said territory being hereinafter more particularly described; and
10
WHERZAS, annexation to the City would make municipal ser-
11
vices available to the property owners and be for the best interest
12
of said owners and the City of Newport Beach and its citizens; and
13
WHEREAS, The Irvine Company, one of the owners of prop -
14
erty in said territory, did on or about the 12th day of April, 1965
15
submit to the Secretary of the Orange County Boundary Commission a
16
proposal for annexation with a legal description and map of the
17
hereinafter described uninhabited territory for its report, and
18
filed said map with the Registrar of Voters, pursuant to the pro -
19
visions of Section 35002 of the Government Code of the State of
20
California; and
21
WHEREAS, The Irvine Company did on or about the 12th day
22
of April, 1965, submit to the Local Agency Formation Commission of
23
Orange County a notice of intention to annex the hereinafter de-
24
scribed uninhabited territory, which notice contained the specific
25
boundaries of said territory, pursuant to Section 54761 of said
26
Government Code; and

WHEREAS, on the 6th day of May, 1965, there was filed
28
with the City Clerk of the City of Newport Beach a report of said

Orange County Boundary Commission stating that the boundaries of
30
said proposed annexation are reasonably definite and certain in
31
accordance with the requirements of Section 35002 of said Govern -
32

WHEREAS, on the 19th day of May, 1965, said Local Agency
Formation Commission approved the proposed annexation; and
MEMPMS, the owners of all of the land within said
territory proposed to be annexed have filed with the City Clerk
their written consent to said annexation;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that proceedings are hereby initiated
pursuant to Sections 35310 and 35310.1 of the Government Code to
annex said territory hereinafter described, which territory is
contiguous to the present boundaries of said City and which said
territory now is uninhabited within the meaning of the Annexation
of Uninhabited Territory Act of 1939 and that the reasons for said
annexation are that it would make municipal services available to
the property oFmers and be in the best interests of said owners and
the City and its citizens that said City annex said territory.
NOTICE IS HMEBY GIVEN that it is proposed by said City
of Newport Beach to annex said hereinafter described territory to
said City, which said territory shall in these proceedings bear the
name of "ANNEXATION NO. 57 ". The specific description of the bound
aries of the territory so proposed to be annexed is attached hereto
marked Exhibit 'W8, and by reference made a part hereof.
FURTHER NOTICE IS HEREBY GIVEN that on P4onday, the 14th
day of June, 1965, at the hour of 7:30 P. M. on said day, or as
soon thereafter as the mattes may be heard, in the Council Chamber
of the City Hall of the City of Newport Beach, 3300 Newport Boule-
vard, Newport Beach, California, a hearing will be had, at which
hearing the City Council shall hear and pass upon all written
protests filed at any time prior to the final adjournment of the
hearing by any person owning real property within the City who
does not also own property in the territory to be annexed.
The City Clerk of the City of Newport Beach is hereby
authorized and directed to cause a copy of this resolution to be

published at least once in the official newspaper of the City, said
publication to be completed at least four days prior to the date
set for the hearing.
