2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NLIQORT BEAC ACCEPTING A GRAHT . DEED FRCN: TIM
3 IRVINE COIMTY AND THE FLUFFS CONVELYING FEE TITLE
4 TO PUBLIC STREET RIGHTS-OF-WAY IN nLACT NO. 5877
5 WHEREAS, the Final Map of Tract No. 5877 has been approved
6 by the City Council; and
7 iiHEREAS, Section 9256.14(a) of the Newport Beach Municipal
8 Code requires that the subdivider s_a ll convey the real property
9 consisting of the public street and alley rights -of -way surrounding
10 a planned residential development to the City in fee and shall
11 covenant therewith that the open space or recreational area lots
12 shall be continuously maintained for the exclusive use and benefit
13 of occupants of the family dwelling units in the subdivision and
14 that access and automobile storage shall be provided; and
15 TZL=,ZAS, The Irvine Company, a rest Virginia corporation,
16 as owner, and The Eluffs, a limited partnership, as its lessee,
17 have delivered a grant deed conveying to the City all such real
18 property within said Tract No. 5877 to comply with said Section
19 9256.14(a); and
20 WHEREAS, the City Council has reviewed said document and
21 determined that it adequately provides for the requirements of said
22 Section 9256.14(a);
23 NON; TI-ZREFORE, BE IT RESOLVED that the City Council of
24 the City of Newport Beach does accept said grant deed and the City
25 Clerk is authorized and directed to execute and attach thereto a
26 certificate of acceptance and consent to its recording and to
27 record said grant deed in the County Recorder's office.
