2 A RESOLUTION OF THE CITY COUNCIL OF TijE CITY OF
JI NEWPORT BELCH APPROVING A NOTICE OF ADDITION OF
3 TERRITORY FOR TRACT NO. 5877 UNDER .NNE .DECLARATION
' OF COVENANTS, CONDITIONS AND RESTRICTIONS APPLICABLE
4 TO TRACTS NOS. 5463,.5480, AND OTHERS AND AUTHORIZ-
ING. THE.N;AYOR AND CITY CLERK _TO..EXECUTE THE SAID ON

7 W EREAS, the City of Newport Beach has previously executed
8 Covenants, - Conditions and Restrictions applicable to Tracts Nos,
9115463, 54809 54352 5692, 5740, 5741, and 5798; and
10 UTHEREAS, a final subdivision map has been approved for
11 Tract No. 5877 which adjoins Tracts Nos. 5435 and 5463; and
12 Mi&RFAS, said Tract No. 5877 is a portion of the planned
13 residential development approved by Use Permit No. 1054(2); and
14 1=21EAS, Declarant has submitted to the City a "Notice of
15 Addition of Territory" in connection with Tract No, 5877 which will
16 subject said tract to the above - mentioned Declaration of Covenants,
17 Conditions and Restrictions; and
18 13:IEREAS, said Covenants, Conditions and Restrictions pro -
19 vide for the approval of the City to be endorsed on said notice;
20 NOW, TIMREFORE, BE IT RESOLVED that the Notice of Addi-
21 tion of Territory is approved by the City, and the Mayor and City
22 Clerk are authorized and directed to execute said notice on behalf
23 of the City.
