A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
2 NMTORT BEACH AUTHORIZING THE EXECUTION OF PUBLIC
UTILITY SUBORDINATION AGREEMENTS

41 T*1ERuAS, The Irvine Company proposes to dedicate to the
5 City of Newport Beach as a public street the existing improved righ
6 of way of the private road located in the City commonly known as
7 Ford Road, which runs generally along the southerly boundary of the
8 Ford Aeronutronic plant site and connects MacArthur Boulevard with
9 Jamboree Road, together with additional right of way; and
10 11HEb'. AS, Southern California Edison Company, Southern
11 Counties Gas Company of California, and The Pacific Telephone and
12 Telegraph Company have existing public utilities facilities and the
13 right to install and maintain public utilities facilities in Ford
14 Road under either a license or grant of right of way from The
15 Irvine Company; and
16 bl-IIEEPREAS, there have been presented to the City Council of
17 the City of Newport Beach certain Public Utility Subordination
18 Agreements between the City of Newport Beach, The Irvine Company,
19 and Southern California Edison Company, Southern Counties Gas
20 Company of California, and The Pacific Telephone and Telegraph
21 Company, respectively, whereby said public utility companies agree
22 to subordinate all existing rights they have in Ford Road to the
23 City's easement; and
24 W1EREAS, the City Council has considered the terms and
25 conditions of said agreements and found them to be reasonable and
26 equitable;
27 NOW, THEREFORE, BE IT RESOLVED that said Public Utility
28 Subordination Agreements be approved and the Mayor and City Clerk
29 are hereby authorized and directed to execute the same on behalf

of the City of Newport Beach.
