A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT :TEACH CONFIRMING REPOR ^t OF STREET

W1MREAS, the City Council of the City of Newport Beach,
6
pursuant to the provisions of Chapter 4 of Article VII of the
7
Newport Beach Municipal Code, by Resolution No. 6104 declared weeds
8
on certain streets, sidewalks, parleways, and private property in
9
said City to be a public nuisance, and designated the Street
10
Superintendent of the City of Newport Beach as the person to give
11
notice to destroy such weeds, which notice was given by him in
12
accordance with the above - mentioned chapter and article of the
13
Municipal Code; and
14
ti•FrMIRMS, pursuant to said notice a public hearing was
15
held to allow protests to the removal of such weeds and, no
16
protests having been made or received, the City Council ordered
17
the Street Superintendent to proceed with the abatement of weeds;
18
and
19
MI S, the Street Superintendent of the City of Nee<7port
20
Beach 'kept an account of the cost of abatement and, upon the com-
21
pletion of said weed abatement, rendered an itemized report in
22
writing to the City Council showing the cost of removing the weeds
23
on or in front of each separate lot or parcel of land; and
24
T::EREAS, before the said itemized report was submitted
25
to the City Council, the Street Superintendent posted a copy of it
26
for at least three days on the bulletin board at the City ball,
27
with a notice that the 12th day of July, 1965, at 7:30 P. 14. had
28
been fixed as the time, and the Council Chambers in the City ball
•

of the City of Newport Beach had been fixed as the place, for
30
submission of said report to the City Council for confirmation and
31
for hearing objections to the acceptance of said work and the
32
assessment of the costs therefor against the parcels of land from
1I which the weed nuisance had been abated, and the required notice
2 was given as provided for by Section 7424 of the Newport Beach
3 Municipal Code; and
4 G;it3E'RWAS, no ob ections to the acceptance of said work
5 and assessment of the costs therefor were submitted to the City
611 Council at said hearing;
7 NMJTIMMErCIRE, BE IT P,ESOLVED that the itemized report
8 of the Street Superintendent of the City of Newport Beach shoeing
9 the cost of removing the weeds on or in front of each separate
101 lot or parcel of land designated therein, which report is attached
11 hereto as Exhibit 'W' and made a part hereof, be and the same is
12 hereby confirmed and the cost of abating the nuisance in front of
13 or upon the various parcels as confirmed shall constitute a special
14 assessment against the respective parcels of land and shall be a
1511 lien thereon until paid.
