2 A 'IESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NDWPORT BEACH AUTHORIZING THE EXECUTION OF AN
3 AMENDI"MNT TO- REINBUt3SEMNT AGREMI,NT BirMPSEN THE
4 CITY OF ZWPORT -BEACH AND TIZI BLUFFS
5j WHEREAS, the City of Newport Beach and The Bluffs are
i
6 parties to a Reimbursement Agreement dated the 17th day of June,
7 1965, for the improvement of Eastbluff Park; and
8 WHEREAS, said agreement makes no provision for the re-
9 imbursement of the Developer for the cost of preparing plans and
10 specifications for the improvement of said public park site, and
11 it is the mutual desire of the parties to amend said agreement to
12 provide for such reimbursement; and
13 I- MREAS, there has been presented to the City Council an
14 Amendment to Reimbursement Agreement Between the City of Newport
15 Beach and The Bluffs revising paragraph 5 of said Reimbursement
16 Agreement to provide that the City will reimburse the Developer
17 for the costs of designing and preparing plans and specifications
18 for the project if a contract for the project is awarded; and
19 'MIEMAS, the City Council has considered the terms and
20 conditions of said agreement and found them to be reasonable and
21 equitable;
22 NOI Tk'.MFORZ, BE IT RESOLVED that said agreement be
23 approved and the mayor and City Clerk are hereby authorized and
24 directed to execute the same on behalf of the City of Newport Beach.
25 ADOPTED this 9th day of August , 1965.
