2I A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
31 AN AGREEMENT FOR INSTALLATION OF UTILITIES

5 WHEREAS, the City of Newport Beach required as a condition
6 of the approval of Resubdivision No. 198 (portion of Lot 169, Block
7 2, Irvine's Subdivision) that certain improvements be installed by
8 the developer, all of which improvements have been installed except
9 underground electrical power facilities connecting the resubdivision
10 with existing facilities in Superior Avenue; and
11 WHEREAS, Raeola Dee McCulloch and Kenneth W, McCulloch,
12 the present owners of said real property, have requested the City
13 to record the resubdivision map and issue a building permit for a
14 convalescent hospital they intend to develop on said property; and
15 AREAS, the City has requested said owners to enter into
16 an agreement guaranteeing the installation of said underground
17 electrical power facilities and to furnish the City with a bond
18 guaranteeing that the same will be installed; and
19 WHEREAS, such agreement has been presented to the City
20 Council and the City Council has reviewed the same and found it to
21 be fair and equitable;
22 NMI, THEREFORE, BE IT RESOLVED that the Mayor and City
23 Clerk are hereby authorized and directed to execute said agreement
24 on behalf of the City of Newport Beach.
