A RESOLUTION OF INT2NTICN OF THE CITY COUNCIL
OF THE CITY OF MI N'PORT BEACH DECLARING ITS
INTENTION TO OPOER THE VACATION OF A STOPM DRAIN
EASaMN -2 IN LOT 7, TRACT 5854

The City Council of the City of Newport Beach, pursuant
to the provisions of the *'?ublic service Basements Vacation Law"
and all amendments thereto, being Sections 50430, et sec., of the
Government Code of the state of California, does hereby resolve and
declare as follows:
SECTION 1. The public interest and convenience require,
and it is the intention of the City Council of the City of k,ewport
Beach to orc.er, the vacation o€ a dental:. sto m drain easement in
the City of Newport Beach, County of Orange, State of California,
described as follm -7s:
That certain 101 easement to the City of ilewport
Beach for storm drain purposes shown On Lot 7,
Tract 5854 as per map recorded in Boo?s 213,
Pages 38 and 39 of Eiscelianeous Laps in the
office of the County Xecorder of Orange County,
California.
Said easement to be vacated is shown on a certain map
entitled 7'10' Storm Drain Easement to be vacated, Lot 7, Tract
5854 ", being City of wewport Beach ;?ublic 1eorks Department Drawir_g
Trio. R/ — 5065 -L, dated 8- 30 -65, a copy of which is marked Exhibit
' "Al2 and attached hereto and by this reference made a part hereof,
and which shall be kept on file in the o € fide of the City Clerk as a
part of this -resolution.
SECTION 2. The proceedings for the vacation of said
easement are taken pursuant to, and the City Council of the City
of ldewport Beach hereby elects to proceed under the provisions o €,
the 69Public Service Basements Vacation Law" and all amendments
thereto, being Sections 50430 to 50445, inclusive, of the Govern-
ment Code of the State of California.
SECTION 3. -The Public [Yorks Director of the City of
11 Newport Beach shall cause to be conspicuously posted along the line
P. of said easement proposed to be vacated, not more than 300 feet
3 apart and not less than three in all, notices of the vacation of
• 4 said easement„ The notices shall state the passage of this resolu-
5 tion of intention and the time and place of the hearing before the
6 City Council of all persons interested in or objecting to the
7 proposed vacation. Said notices shall be posted at least ten days
8 before the date of said hearing.
9 SECTION 4. Notice is hereby given that the City Council
10 of the City of Newport ; 3each does hereby fix Pronday, the 25th day
11 of October, 1965, at the hour of 7:30 o'clock P. K. on said day,
12 in the Council Chamber located in the City Hall of the City of
13 1 Newport Beach at 3300 Newport Boulevard, Newport reach, California,
14IIas the time and place for hearing all persons interested in or
1511 objecting to the proposed vacation of said easement.
16i SECTION 5. A notice of the hearing hereir_before set,
17 giving the date, time and place of said hearing, shall be published
18 by the City Clerk in the official newspaper of the City once each
19 week for at least two successive weeks prior to said hearing.
