HomeMy WebLinkAbout6236 - Assessment District 50 - Balboa Island Street Lighting0 Tt � B/65 (12) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 6236 r A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWORT BEACH DENYING ALL PROTESTS TO .A PROPOSED INPROVMMT CONSISTING OF THE INSTALLATION OF STREET LIGHTS AND APPURTENANCES IN ASSESSMENT DISTRICT.NO. 50 (BALBOA ISLAND SMET LIGHTING DISTRICT), ESTABLISHING SAID ASSESSMENT DISTRICT PURSUANT-TO THE PROVISIONS OF THE STREET.LIGHTING ACT OF 1919, ORDERING THAT THE PROPOSED. IMPROVE - IMNT BE FADE, AND DETEMINING .THAT THE REgUIREMENT FOR PUBLIC BIDS SHALL BE WAIVED WEEMEAS, on the 13th day of September, 1965, the City Council adopted Resolution No. 6214 declaring its intention to order an improvement consisting of the installation of incandescent street lights in the alleys of Balboa Island in the City of Newport Beach in accordance with the preliminary report filed by the Public Works Director with the City Clerk and approved by the City Council on the 23rd day of August, 1965; and IHEREAS, said Resolution No. 6214 provided that Monday, the 25th day of October, 1965, at the hour of 7:30 P. M. was set as the day and hour when all interested persons having filed a writ ten protest may appear at the Chambers of the City Council and show cause why the City Council should not order the proposed improvemen to proceed; and WHEREAS, notice of said protest hearing was duly given by posting and publication in accordance with the notice requirements set forth in the Street Lighting Act of 1919, Division 14, Part 1 of the Streets and Highways Code of the State of California; and WH3s'REAS, at the time appointed therefor the City Council heard and considered all protests by persons objecting to the pro- posed improvement or the assessment therefor; NOW, THEREFORE, the City Council of the City of Newport Beach does hereby find, resolve and order as follows: 1. That all protests or objections to the proposed improvement are denied. 1 2. That the proposed assessment as shown in the prelim 2 inary report of the Public Works Director is confirmed. 3 3. That it is ordered that the proposed improvement 4 shall be made. 5 49 That the improvement shall be for a period of 6 twenty (20) years, commencing on December 1, 1965, and ending on 7 December 1, 1985. 8 5. That the City Council hereby determines that the 9 alternative procedure for levying and collecting assessments on an 10 ad valorem basis pursuant to Chapter 8.5, Part 1, Division 14 of 11 the Streets and highways Code shall be followed. 12 6. That the boundaries of the district shall be as 13 shown on that certain map, entitled "Street Lighting Assessment 14 District on Balboa islandP9, Drawing No. E- 4993 -S, which is 15 designated Exhibit P0A7° and attached to the preliminary report of 16 the Public Works Director and to Resolution of Intention No. 6214. 17 7. That the estimated cost of the improvement for the 18 first fiscal year, ending on June 30, 1966, is two thousand five 19 hundred and sixty -two dollars ($2,562). 20 8. That said estimated cost shall be paid by special 21 assessment taxes levied upon all the lands, exclusive of improve - 22 meats, within the district, except that if any lots or parcels of 23 land owned by the City of Newport Beach are included within the 24 assessment district, all of such land shall be omitted from the 25 assessment hereafter to be made to cover the costs of said improve - 26 ment. 27 9. That pursuant to Section 18171 of the Streets and 28 Highways Code, the City Council hereby finds and determines that 29 there is only one contractor, namely, the Southern California 30 Edison Company, that is practically capable of serving the street 31 lighting system to be installed in accordance with the plans and 32 specifications contained in the preliminary report of the Public 2. 4 f I I Works Director and that such contractor is subject to the jurisdic- 2 Lion of the Public Utilities Commission of the State of California. 3 Therefore, the City Council hereby waives the requirement of com- • 4 petitive bidding and orders the improvement to be carried out by 5 the Southern California Edison Company in accordance with rates and 6 rules filed by it from time to time with said Public Utilities 7 Commission. 8 10.
