HomeMy WebLinkAbout6333 - General Municipal Election Results - 4-12-66• THS -.aem 4/5/,66 RESOLUTION N0, 6333 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE 12TH DAY OF APRIL, 1966, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW WHEREAS, a regular general municipal election was held and conducted in the City of Newport Beach, County of Orange, State of California, on Tuesday, the 12th day of April, 1966, as required by law; and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast.thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of Cali- fornia for the holding of elections in cities; and WHEREAS, pursuant to Resolution No. 6318 adopted the 28th day of March, 1966, the City Clerk canvassed the returns of said election and has certified the regUlts to this City Council, said results are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, the City Council of the City of Newport Beach does resolve as follows-. SECTION to That there were 48 voting precincts estab- lished for the purpose of holding said election consisting of con- solidations of the regular election precincts in the City of`New- port Beach as established for the holding of state and county elections. SECTION 20 That said regular general municipal electic was he}d for the purpose of electing the following officers of said City as required by the laws relating to. cities in the State of California, to wit- Four members of the City Council of said City for the full term of four years. 0 t SECTION 3. That at said regular general municipal elec- tion, the following measures were submitted to the electors of said City, to wit.. Thirteen proposed Charter Amendments, desig- nated as Proposed Charter Amendments Numbers One through Thirteen. SECTION 4. That the whole number of votes cast in said City, except absent voter ballots, was 6951 that the whole number of absent voter ballots cast in said City was 77 making a total of 7028 votes cast in said City. SECTION S. That the names of persons voted for at said election for Members of the City Council are as follows- follows: District Two; Donald E. Elder Howard Rogers District Three- Doreen Marshall Glyn Price District Four- Paul J> Gruber Paul A. Hanna District Seven- Robert H. Shelton That the measures voted upon at said election are as PROPOSED CHARTER AMENDMENT NUMBER ONE- Shall Section 402 of the Charter be amended to increase the reimbursement to members of the City Council for out -of- pocket expenditures and costs from One Hundred to Two Hundred Dollars per month? PROPOSED CHARTER AMENDMENT NUMBER TWO- Shall Section 404 of the Charter be amended to increase the maximum amount from Fifty to One Hundred Dollars per month which the Council may authorize by resolution as an additional expense allowance to the Mayor? PROPOSED CHARTER NUMBER THREE: Shall Section 602 of the Charter be amended to provide that the City Attorney shall prosecute misdemeanor offenses arising under State law if authorized and directed to do so.by ordinance or resolution adopted by the City Council? PROPOSED CHARTER AMENDMENT NUMBER FOUR: Shall Section 610 of the Charter be amended to make the existing Charter 2, 1107 of the Charter be amended to increase the maximum special tax which the City Council could impose for library purposes from'ten to fifteen cents on each One Hundred Dollars of the assessed value of taxable property in the City? PROPOSED CHARTER AMENDMENT NUMBER NINE: Shall Section 1110 of the Charter, which concerns contracts for public works projects, be amended to provide that the public bid requirements shall apply to projects involving a total expenditure exceeding Five Thousand Dollars, or such lesser amount as may be established by ordinance, instead of the existing provision that public bid requirements shall apply to any project.involving a total expend- iture in excess of Three Thousand Dollars? PROPOSED CHARTER AMENDMENT NUMBER TEN: Shall Section 1110 of the Charter, which concerns contracts for public works 30 restrictions against nepotism apply to.appoi.ntments to positions within the Civil Service System as well as.to non -Civil Service positions? • PROPOSED CHARTER AMENDMENT NUMBER FIVE: Shall Section 706 of the Charter be amended to reduce the number of Planning Commissioners from nine to seven and to require the Planning Dir- ector to attend the meetings of the Planning Commission in an advisory capacity? PROPOSED CHARTER AMENDMENT NUMBER SIX: Shall Section 709 of the Charter be amended to change the title of the Recre- ation Director to Parks, Beaches and Recreation Director? PROPOSED CHARTER AMENDMENT NUMBER SEVEN: Shall Section 1005 of the Charter be amended to provide that the names and respective boundaries of the seven councilmanic districts shall be as established by ordinance; shall Sections 1006 through 1012 of the Charter, which contain obsolete descriptions of the seven councilmanic districts, be deleted from the Charter; and shall Section 1013 of the Charter be renumbered to Section 10067 PROPOSED CHARTER AMENDMENT NUMBER EIGHT: Shall Section 1107 of the Charter be amended to increase the maximum special tax which the City Council could impose for library purposes from'ten to fifteen cents on each One Hundred Dollars of the assessed value of taxable property in the City? PROPOSED CHARTER AMENDMENT NUMBER ELEVEN: Shall Section 1113 of the Charter be amended to change the title of the Section from "Capital Outlays Fund" to "Capital Improvement Fund1° and to change the term "capital outlay" or "outlays" to "capital improve- meet" or "improvements" throughout the Section? PROPOSED CHARTER AMENDMENT NUMBER TWELVE: Shall Section 1114 of the Charter be amended to provide that all claims for dam- ages against the City shall be filed in accordance with the re- quirements prescribed by ordinance except as otherwise provided by the provisions of State law applicable to chartered cities and to delete the specific requirements for filing such claims pres- ently included in the Charter which have become obsolete because of changes in State laws; shall Section 1116 of the Charter relat- ing to lawsuits against the City which is in conflict with State law be repealed; and shall Section 1117 of the Charter be renum- bered to Section 1116? PROPOSED CHARTER AMENDMENT NUMBER THIRTEEN: Shall the Charter be amended to add Section 1402 (d) to authorize the City Council to sell and convey that parcel of City -owned real prop- erty on the south side of Balboa Boulevard between E and F Streets described as follows: That portion of Section Thirty -five (35), in Township Six (6) South, Range Ten (10) West, San Bernardino Base & Mer- idian together with that portion of Fractional Section Two (2), in Township Seven (7) South, Range Ten (10) West, San Bernardino Base & Meridian shown as Parcel "A" on the map recorded in Book 80, Page 48 of Record of Surveys in the office of the County Recorder of Orange County, California, and described as follows: Beginning at the most westerly corner of Lot 8, Block 22, Eastside Addition to Balboa Tract as show�on the map recorded in Book 4, Page 20 of Miscellaneous Maps in the office of the County Recorder of said County; thence S 700 10° 0011 E. 3078 feet to the True Point of Beginning; thence continuing S 700 10° 00" E'26<22 feet; thence N 190 50° 00" E. 9.46 feet; thence West 27°87 feet to the True Point of Beginning? 4e • That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said persons were candidates and for and against the measures were as listed in Exhibit "A" attached. that: SECTION 6. The City Council does declare and determine Howard Rogers was elected as a Member of the City Council from the Second District for the full term of four years. Doreen Marshall was elected as a Member of the City Council from the Third District for the full term of four years. Paul J. Gruber was elected as a Member of the City Council from the Fourth District for the full term of four years. Robert H. Shelton was elected as a Member of the City Council from the Seventh District for the full term of four years. That as a result of said election, the vote on the pro- posed charter amendments was as follows: A majority of the qualified voters voting on Charter Amendment Number One did vote in favor thereof and it was adopted. A majority of the qualified voters voting on Charter Amendment Number Two did vote in favor thereof and it was adopted. A majority of the qualified voters voting on Charter Amendment Number Three did vote in favor thereof and it was adopted A majority of the qualified voters voting on Charter Amendment Number Four did vote in favor thereof and it was adopted. A majority of the qualified voters voting on Charter Amendment Number Five did vote in favor thereof and it was adopted, A majority of the qualified voters voting on Charter Amendment Number Six did vote in favor thereof and it was adopted. A majority of the qualified voters voting on Charter Amendment Number Seven did vote in favor thereof and it was adopt= A majority of the qualified voters voting on.Charter Amendment Number Eight did vote in favor thereof and it was adopt-- 5. The City Clerk shall immediately make and, upon compliance by the persons elected with,the provisions of Section 11565 and Section 11568 of the Elections Code of the State of California relating to the filing of campaign statements, shall deliver to each of such persons so elected a Certificate of Elec- tion signed by her and duly authenticated, shall administer to each person elected the Oath of Office prescribed in the State Constitution of the State of California and shall have them sub- scribe thereto and file the same in her office.
