RESOLUTION NO. 6358

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEE4PORT BEACH APPROVING A NOTICE OF ADDITION OF
3
TERRITORY FOR TRACT NO. 5877 UNDER THE DECLARATION
OF COVENANTS, CONDITIONS AND RESTRICTIONS APPLICABLE

TO TRACTS NOS. 5463,.54800 AND OTHERS.AND AUTHORIZING
ITS EXECUTION ON BEHALF OF THE CITY

WHEREAS, the City of Newport Beach has previously execute
7
Covenants, Conditions and Restrictions applicable to Tracts Nos.
a
5463, 5480, 5435, 5692, 5740, 5741, and 5798; and

WHEREAS, a final subdivision map has been approved for
10
Tract No. 5877 which adjoins Tracts Nos. 5.435 and 5463; and
11
WHEREAS, said Tract No. 5877 is a portion of the planned
12
residential development approved by Use Permit No. 1054(E); and
13
WH;.�REAS, the City has previously approved a Notice of
14
Addition of Territory for Tract No. 5877 dated May 20, 1965, as
15
shown on a map thereof recorded in Book 218 at pages 10, 11, 12,
16
13, on July 9, 1965, Miscellaneous Maps, Records of Orange County,
17
California; and
is
'H�cEREAS, on May 9, 19663, the City Council adopted Resolu-
19
tion No. 6357 which authorized the execution on behalf of the
20
City of a document entitled "Notice to Vacate Addition of Terri
21
tort'" which vacated, terminated, and cancelled said Notice of
22
Addition of Territory dated May 20, 1965; and
23
THM EAS, The Irvine Company and The Bluffs have submit -
24
ted to the City Council a new Notice of Addition of Territory which
25
is intended to replace the prior Notice of Addition of Territory
26
for Tract No. 5877 and which will subject Lots 1 through 49,
27
inclusive, and Lot 96 of said tract, with the exception of that
28
portion of Lot 96 described in Exhibit "A" attached to said Notice
29
of Addition of Territory, to the above - mentioned Declaration of
•
30
Covenants, Conditions and Restrictions; and
31
11HEREAS, said Covenants, Conditions and Restrictions pro -
32
vide for the approval of the City to be endorsed on said notice;

NMI, THEREFORE, BE IT RESOLVED that the Notice of Addi-
tion of Territory is approved by the City, and the Mayor and City
Clerk are authorized and directed to execute said notice on behalf
of the City.
ADOPTED this 9th day of May, 1966.
