III RESOLUTION NO. 6407
21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MIECUTION OF
3 COVENANTS, CONDITIONS, AND RESTRICTIONS.BEING
IMPOSED UPON TRACTS NOS. 5877 AND 6227 AND.
4 RESCINDING RESOLUTION NO. 6380

6 WHEREAS, by Resolution No. 6380 adopted June 13, 19660
7 the City Council of the City of Newport Beach authorized execution
8 of a document entitled "Declaration of Covenants, Conditions and
9 Restrictions Tract No. 6227 "; and
10 WHEREAS, said Declaration of Covenants, Conditions and
11 Restrictions has not been recorded and it is the intention of the
12 parties that Resolution No. 6380 be rescinded; and
13 WHEREAS, there has been presented to the City Council by
14 The Irvine Company, a West Virginia corporation, as owner, and The
15 Bluffs, a limited partnership, as its lessee and subdivider of
16 Tracts Nos. 6227 and 5877, a document entitled '&Declaration of
17 Covenants, Conditions and Restrictions, Tract No. 6227 and Tract
18 No. 5877 ", whereby covenants, conditions and restrictions are
19 imposed upon said tracts; and
20 WHEREAS, The Irvine Company is the owner and The Bluffs
21 is the lessee of all lots in said tracts and propose to imose said
22 Declaration of Covenants, Conditions and Restrictions upon said
231 tracts for the benefit of all of the lots therein and for the
24I benefit of the adjoining land oened by the City; and
25 WHEREAS, the City Council has reviewed said document and

26 determined that it adequately provides for the permanent upkeep,
27 maintenance, and payment of taxes on the common area lots within
28 said tracts, as required by Section 9256.13 of the Newport Beach
29 Municipal Code;
30 NOW, THEREFORE, BE IT RESOLVED that Resolution No. 6380
• 31 is hereby rescinded and the Mayor and City Clerk are hereby
32 authorized and directed to execute the Declaration of Covenants,

1 Conditions and Restrictions described above on behalf of the City
2 of Newport Beach.
3 ADOPTED this 27th day of June 1966.

Beach, California, at a regular meeting of said City Council held at the
