2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPERT BEACH AUTHORIZING THE E7MCUTION' OF A
3 QUITCLkIEt DEED ADD AN AGRSMMNT RELENTING TO THE

5 17HUMS, the City of Newport Beach,, by an indenture dated
6 14ay 1, 1923, recorded in Book 183 , page 244, of Official Records
7 of ®range County, California, was granted an easement and right of
8 way to lay, construct, maintain, operate, repair and renew a cast
9 iron pipe for the transportation of water over, under, above and
10 through that certain parcel of land situated in the County of
11 Orange, State of Californiq and described as follows, to wit:
12 A strip of land ten (10) feet in width, the center line of
which is described as follows:

Beginning at a point in the North line of the South Ralf
14 of the Northwest Quarter of the Southeast Quarter of
Section Eighteen, Townshi Six South Range Ten West,
15 (S 1/2 of M 1/4 of SE 1/� of Sec. 16, T. 6 s., Ro 10 170),
S. B. B« & 14., Two Hundred (200) feet Nast of the Hest
16 line of said Southeast quarter (SE 1/4); thence South
Forty-six degrees Forty -eight minutes East (S. 46° 43' E.)
17 Two Thousand Eight Hundred Ninety-two and Forty-seven
Hundredths (2892.47) feet, more or less, to a point in
18 the South line of said Section Eighteen (18) Two Thousand
Three Hundred Eight and Twenty-nine Hundredths (2308.29)
19 feet East of the Southwest corner of.Southeast Quarter
(SB 1/4) thereof;

22 LJIIII.ZEAS, Oka Brothers have succeeded to the rights,
23 duties and liabilities of the Pacific Ranch Company, the original
24 grantor of said easement; and
25 MdEREAS, Oka Brothers is desirous of having the City of
26 Newport Beach abandon the above sentioned water line, and grant to
27 Oka Brothers a quitclaim deed to the easement specified above; and
28 $JI1Eh, the May 1, 1923, indenture contains a provision
29 that, in the event the therein contained grant of right of way
30 shall be terminated for any cause, the City of Newport Beach will,
31 immediately upon such termination, at its own expense and risk,
32 remove all pipe placed upon said land and restore said premises as

1 nearly as possible to the same state and condition they were in
2 prior to the construction of said pipe line; and
3 WHEREAS, the City has secured a water line connection to
4 the Huntington Beach water system, which will adequately replace the
5 above mentioned water pipe; and
6 1EAS, the City has no present or future need for the
7 easement as above described; and
8 ITHEREAS, Oka Brothers, Incorporated, the present owner
9 of the property in which the above described easement is located,has
10 requested that such easement be abandoned, and has agreed to assume
11 all risk, post and responsibility for the abandonment, removal or
12 nonremoval of the water pipe line in said easement;
13 W0£7, THEREFORE, BE IT RESOLVED that the Mayor and City
14 Clerk be and are hereby authorized to execute a quitclaim deed
15 releasing the City's interest in the above easement, and an agreemen
16 relieving the City of any and all obligations regarding the abandon-
17 ment of said pipe line.
