TITLE: Resolution Supporting Subrn\ssion of Grant Applications under the
Orange County TransportationjA�uttorit��OCTA) Measure M2
Environmental Cleanup Grant Program
ABSTRACT:
Staff plans on submitting several applications to OCTA to obtain funding to construct
various water quality improvemenlfprotectsfthroughout the City. The applications require
the City Council to adopt a resolu,tri endorsing the grant applications.
RECOMMENDATION
Adopt Resolution 1 t, 2013 -_ authorizing and supporting submission of grant
applications for OCTAS`Measure M2 Environmental Cleanup Tier 1 and Tier 2, grant
programs.
Staff is planning to request approximately $500,000 from the up- coming OCTA Tier 1
grant application call for projects. Should the City be successful and awarded the full
amount, the City's minimum match requirement will be 25% or approximately $125,000.
The match would be met through in -lieu contributions, e.g. staff inspection, maintenance
and from Tidelands Fund. The Tidelands Fund dollar amount is estimated at $75,000
and would be appropriated with the adoption of a future Capital Improvement Program
budget or at the time of a contract award to perform the work.
Staff also is planning to request approximately $2,000,000 from the OCTA Tier 2 grant
program. Should the City be successful and awarded the full amount, the City's

minimum match requirement will be between 25 % -50% or approximately $500,000 -
$1,000,000. The match will be met through in -lieu contributions, e.g. staff inspection,
maintenance and from the Tidelands Fund. The Tidelands Fund dollar amount is
estimated at $375,000 - $750,000 and would be appropriated with the adoption of a
future Capital Improvement Program budget or at the time of a contract award to
perform the work.
DISCUSSION:
OCTA has established and is administrating an environmental cleanup grant funding
program to address water quality degradation associated with transportation - generated
pollution as a component of Measure M2. Measure M2 is a half -cent sales tax for
transportation improvements approved by Orange County voters in 2006.
For the Tier 1 grant program, a total of $19.5 million is projedt'edd to be available over a
seven -year period that began in FY11/12. Approximately $2!8 million is available to be
awarded with this grant "Call for Projects." Staff plans to submit several applications
under this Call for Projects that will be used to insta�tra`sh collecting devices and
irrigation retrofits. Trash collecting devices such as Continuous Deflective Separation
(CDS) units and trash and debris booms will capture and remove trash and debris from
the storm drain system and the Bay. Irrigation retrofit projects will target various street
medians (e.g. Jamboree Road. and San Joaquin,tHlls Road).
For the Tier 2 grant program which isj�ected at larger and more regional projects, a
total of $38.5 million is projected to be available over a two -year period beginning in
FY12/13. Approximately $25 million is., to be awarded with this grant "Call for
Projects." Staff plans to submit set e al applications under this Call for Projects that will
be used for such items as removal of sediment material relating to roadway runoff, low
flow storm draint' iversi ns to the sewer system and /or installing
trash /sediment/pollutaftit``t coffin- 10 . Proposed projects include dredging drainage outlet
areas, providing some4ll, vel of treatment or diverting the "Arches" storm drain low flow,
and installing sediment/�erosion controls within the Upper Newport Bay. Note: detailed
eligibility and grant submi tal requirements will be released by OCTA later this summer.
As required by the grant application, an adopted resolution must be submitted with the
applications stating that the 1) City Council has reviewed and supports the applications,
2) City is capable of providing the required match funding and /or in -kind contributions,
projects and 3) City agrees to work with OCTA to meet established deadlines. If
awarded a grant, the City Council will be asked to accept the grant funds at a future
meeting date.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the

environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO. 2013-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH AUTHORIZING AND SUPPORTING THE SUBMISSION OF A
GRANT PROPOSAL FOR FUNDING UNDER THE ORANGE COUNTY
TRANSPORTATION AUTHORITY (OCTA) ENVIRONMENTAL
CLEANUP, TIER 1 AND TIER 2 GRANT PROGRAM.
WHEREAS, the Orange County Local Transportation Ordinance No. 3, dated
July 24, 2006, known and cited as the Renewed Measure M Transportation Ordinance
and Investment Plan, has announced funding available through the Environmental
Cleanup Program to help protect Orange County beaches and waterways from
transportation generated pollution (urban runoff) and improv over II water quality; and
WHEREAS, the Environmental Cleanup, Tier 11:;, Grant Program consists of
funding to purchase and install catch basin Bestt,�Ma��nag_em4t Practices (BMPs), such
as screens, filters, inserts, trash collection devic�ceand other "street- scale' low flow
diversion projects; and
WHEREAS, the Environmental Cleanup, Tier 2 Grant Program consists of
funding to purchase and install
larg� scale BMPs, such as trash collection devices,
constructive wetlands�infiltratio) basins and low flow diversion projects; and
WHEREAS, the Orange`COunty Transportation Authority has established the
procedures and criteria�_fffr reviewing proposals; and
WHEREAS, the pity of Newport Beach has developed a targeted program to
reduce transportation generated pollution and improve water quality;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH DOES RESOLVE AS FOLLOWS:
Section 1. The City Council has reviewed and supports the proposal, and
hereby authorizes the City Manager or his designee to submit the proposal.
Section 2. The City of Newport Beach is capable of providing the amount of
funding and /or in -kind contributions, specified in the funding plan and agrees to provide
necessary funding and /or in -kind contributions if awarded a grant.
Section 3. If awarded a grant, the City Council (at a future meeting) will decide
to accept the funds and work with OCTA to meet established deadlines.
Section 4. This resolution shall become effective immediately upon its passage
and adoption.
HEREBY CERTIFY that the foregoing resolution was duly and regularly
adopted at a Regular Meeting of the City Council of the Cilvof Newport Beach on this
