Brown, City Clerk APPROVED: A " TITLE: APPOINTMENT BY MAYOR OF AD HOC APPOINTMENTS COMMITTEE TO REVIEW APPLICATIONS AND MAKE RECOMMENDATIONS TO THE FULL COUNCIL FOR THE BOARD AND COMMISSION VACANCIES SCHEDULED TO OCCUR ON JUNE 30, 2013 ABSTRACT: The annual vacancies on City Boards and Commissions will occur on June 30, 2013. The process to fill the vacancies shall be followed in accordance to Council Policy A -2 — Board and Commission Appointments. RECOMMENDATION: a) Confirm Mayor Keith Curry's appointment of Mayor Pro Tern Rush Hill, Council Member Nancy Gardner, and Council Member Ed Selich to serve on the Ad Hoc Appointments Committee to review applications and make recommendations to the full Council for the Board and Commission vacancies scheduled to occur on June 30, 2013. b) Direct the City Clerk to post and publish a Vacancy Notice requesting that applications be submitted by 1:00 p.m. on Wednesday, May 15, 2013; schedule confirmation of nominees to be made on June 11, 2013; and make appointments on June 25, 2013. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. Appointment by Mayor of Ad Hoc Appointments Committee to Review Applications and Make Recommendations to the Full Council for the Board and Commission Vacancies Scheduled to Occur on June 30, 2013 April 23, 2013 Page 2 DISCUSSION: On June 30, 2013, the following vacancies will occur on City Boards and Commissions: Board of Library Trustees (one seat) - Seat held by Stephanie Murguia (eligible for reappointment). Building and Fire Board of Appeals (four seats) - Seats held by Ernie Liske (not eligible for reappointment) and Richard Luehrs (not eligible for reappointment). There are also currently two vacant seats whose terms expire on June 30, 2016. City Arts Commission (three seats) - Seats held by Caroline Logan (eligible for reappointment), Carole Boller (eligible for reappointment), and Christopher Trela (eligible for reappointment). Civil Service Board (one seat) - Seat held by Mike Talbot [City Council nominee] (eligible for reappointment). Harbor Commission (two seats) - Seat held by Ralph Rodheim (not eligible for reappointment) and David Girling (eligible for reappointment). Parks, Beaches & Recreation Commission (two seats) - Seat held by Phillip Lugar (not eligible for reappointment) and Marie Marston (eligible for reappointment). Planning Commission (two seats) - Seat held by Michael Toerge (not eligible for reappointment) and Bradley Hillgren (eligible for reappointment). Consistent with Council Policy A -2, the above stated vacancies will be advertised and applications will be accepted until 1:00 p.m. on Wednesday, May 15, 2013. Following the interview process, the nominations will be scheduled for confirmation by the full City Council on Tuesday, June 11, 2013, and the final appointments will be made on Tuesday, June 25, 2013. All new terms will be effective on July 1, 2013 with an expiration date of June 30, 2017, excluding the two current vacant seats on the Building and Fire Board of Appeals, whose terms will expire on June 30, 2016. City Council Policy A -2 establishes the procedures for making appointments to the various Boards and Commissions. Appointment by Mayor of Ad Hoc Appointments Committee to Review Applications and Make Recommendations to the Full Council for the Board and Commission Vacancies Scheduled to Occur on June 30, 2013 April 23, 2013 Page 3 Pursuant to City Council Policy A -2, the Ad Hoc Committee's duties are as follows: A. Review all applications for position to City Boards and Commissions. The Ad Hoc Appointments Committee will review applicant answers to all questions contained in the application; B. Conduct any necessary interviews with individual applicants; and C. At least two weeks prior to the date of appointment, recommend to the full City Council at a regular public meeting, two or more candidates for each Board or Commission vacancy. Members of the Council may wish to interview the recommended candidates further prior to final selection by the Council. By requiring two or more candidates for each vacancy, it is the intent of the City Council that at least two separate individuals should be considered for each vacancy, i.e., if there are two vacancies, at least four separate individuals will be considered. Once the final appointments are made by the City Council, the Ad Hoc Appointments Committee will be dissolved. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). The deadline for filing applications is 1:00 p.m. on Wednesday, May 15, 2013.
