Brown, City Clerk APPROVED: � A TITLE: CITY COUNCIL DIRECTION RELATIVE TO APPOINTEES SERVING ON MULTIPLE BOARDS, COMMISSIONS OR COMMITTEES ABSTRACT: To afford maximum citizen participation, City Council Policy A -2 (Board and Commission Appointments) generally allows an appointee to serve on one Board, Commission or Committee at one time. At present, some appointees are serving on more than one Board, Commission or Committee. Staff seeks direction from the City Council regarding appointees that are serving on multiple Boards, Commissions or Committees. RECOMMENDATIONS: a) Provide direction relative to the current appointments listed in the staff report. b -1) If the City Council determines that certain appointments are appropriate, authorize individual appointees, by majority vote, to serve on multiple Boards, Commissions or Committees. X2 b -2) Require appointees to select a single Board, Commission or Committee and to vacate their other position(s) and direct the City Clerk to advertise for the vacated positions. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. This restriction may be waived by a majority vote of the City Council. The following members are currently serving on more than one Board, Commission or Committee: Council Policy A -2 was previously waived to allow Ralph Rodheim to sit on the Harbor Commission and the Balboa Village Advisory Committee (BVAC); however, he also sits on the Balboa Village Business Improvement District'. Thomas Anderson sits on the Parks, Beaches and Recreation Commission and the Aviation Committee (appointed on February 24, 2009). Carl Cassidy sits on the Environmental Quality Affairs Committee (EQAC) and the Water Quality /Coastal Tidelands Committee. David Salisbury sits on the Balboa Village Advisory Committee (BVAC) and the Newport Beach Restaurant Association Business Improvement District. Jim Walker sits on the Corona del Mar Business Improvement District and the Newport Beach Restaurant Association Business Improvement District. Ali Zadeh sits on the Corona del Mar Business Improvement District and the Newport Beach Restaurant Association Business Improvement District. Sheri Drewry sits on the Marine Avenue Business Improvement District and the Newport Beach Restaurant Association Business Improvement District. John Robinson sits on the Marine Avenue Business Improvement District and the Newport Beach Restaurant Association Business Improvement District. It should be noted that the Balboa Village Business Improvement District and the Marine Avenue Business Improvement District are proposed to be disestablished. Pursuant to City Council Policy A -2, the City Council has the ability, by majority vote, to waive the restriction that limits service to one Board, Commission or Committee. Alternatively, the City Council may require the appointees listed in this staff report to select a single Board, Commission or Committee. In which case, the appointees would vacate their positions on the other Board, Commission or Committee. ' Appointments to the Business Improvement District (BID) advisory boards are made by the City Council pursuant to the California Streets and Highways Code rather than City Council Policy A -2. However, for purposes of this item, staff has included the BID appointments as well to give the City Council a complete picture of an appointee's service to the City. Multiple Appointments to Boards, Commissions or Committees April 23, 2013 Page 3 ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
