21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
3 OF NEWPORT BEACH ACCEPTING A GRANT OF EASEMENT
41 WHEREAS, The Irvine Company, a West Virginia corpor-
5i ation, as Landowner and Lessor, and Mobil 0i1 Corporation, a cor-
6 poration, as Lessee, have executed and delivered to the City of
7 Newport Beach a Grant of Easement, which grants to the City an
8 easement for street and highway purposes over all that certain
9 land situated in the City of Newport Beach, County of Orange,
10 State of California, described as follows:
lll That portion of Block 94 of Irvine's'Subdivision, in the
City of Newport Beach, County of Orange, State of California,
12 as per map filed. in Book 1, page 88 of Miscellaneous Record
Maps, in the office of the County Recorder of said County,
13 described as follows:
14' BEGINNING at a point on the Northerly right of way line
of Coast Highway, 100.00 feet wide, said point being the
15i Easterly terminus of that certain course described as
"South 780 33' 07" East 20.00 feet" in Parcel "C" of the
16 Easement Deed to the City of Newport Beach, recorded June
17, 1966,.in Book 7964, pages 631 through 635 inclusive of
17 Official Records; thence South 78° 33' 0701 East along said
Northerly right of way line, a distance of.373.05 feet;
18 thence North 12° 35' 3911 East 10.77 feet; thence North
77° 24' 2100 West 253.84•feet to the beginning of a tangent
19 curve concave Northeasterly having a radius of 30.00 feet,
said curve being tangent to the Easterly right of way line
20 of Jamboree Road, 132.00 feet wide, as described in Parcel
"A" of said Easement Deed to the City of Newport Beach;
21 thence Westerly, Northwesterly and Northerly along said
curve through a central angle of 1010 51' 17B° an arc
22i distance of 53.33 feet to a point of cusp with said Easterly
riot of way line, a radial to said point bears North 650
23 33 03" West; thence Southerly along said Easterly right of
way line being the arc of a curve concave Easterly having
24 a radius of 1134.00 feet, through a central angle of 1° 42'
114° an arc distance of 33.71 feet to the Northwesterly
25 terminus of that certain course described as "North 280
09' 14" West 25.50 feet" in said Parcel 11C "; .thence South
26 28° 09' 1479 East along said last mentioned-course 25.5O
feet to the point of beginning.

SUBJECT TO any and all existing easements and rights of
28 way.of. record or apparent;

301 WHEREAS, the Grant of Easement provides that it is made

upon the express condition
that in
the
event of the
taking
of the

underlying fee interest by
exercise
of
the power of
eminent
domain

by Grantee or any successor or assign of Grantee, or the State
of California, the valuation of said underlying fee interest
shall not be diminished by reason of the easement, and for such
purposes the easement shall be deemed as terminated as of the
date of said taking; and
WHEREAS, it is to the interest of the City to accept
said Grant of Easement;
NOW, THEREFORE, BE IT RESOLVED that said Grant of
Easement is Hereby accepted and the City Clerk is authorized and
directed to execute and attach thereto a certificate of acceptance
and consent to its recording and to record said document in the
County Recorder's office.
ADOPTED this 25th day of March 1968.

do hereby certify that according to the records of the City of Newport Beach
filed and maintained in my office, the foregoing Resolution No. 6736 was
duly and regularly adopted, passed, and approved by the City Council of the
City of Newport Beach, California, at a regular meeting of said City Council
held at the regular meeting place thereof, on the 25th day of March 1968
by the following vote, to wit:
AYES, COUNCILMEN: Rogers, Parsons, Marshall, Gruber, Cook,
Forgit, Shelton
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: None
