5 Ii3PiEEREAS, the City of Newport Beach and The Irvine
6 Company, as subdivider, are parties to an agreement under which
7 the subdivider agreed to install street and other public improve -
8 meats in Tract No. 4225; and
9 MiE EAS, the City Council has heretofore granted to
10 subdivider extensions of time for the construction of sidewalks
11 parallel to a portion of TYestcliff Drive, and the subdivider has
12 requested a further extension of time for the construction of
13 said sidewalks which the City Council approved subject to certain
141 conditions; and
15 M.REAS, there has been presented to the City Council
161 an agreement entitled "Subdivision Agreement (Sidewalk Construc-
17 Lion - Tract No. 4225)'' providing for the waiver by the City of
18 Irvine's obligation for said sidewalk construction until July 1,
191 1972, subject to certain conditions more specifically set forth
20 therein; and
21 4IERZA13, the City Council has considered the terms and
22� conditions of said agreement and found them to be fair and
23 equitable;

251 approved and the Mayor and City Clerk are authorized and directe-
261 to execute the same on behalf of 'the City.
