WHEREAS, there is situated outside of and contiguous to the City of Newport Beach certain uninhabited territory within the meaning of the Annexation of Uninhabited Territory Act of 1939, said territory being hereinafter more particularly described; and WHEREAS, annexation to the City would make municipal ser- vices available to the property owners and be for the best interests of said owners and the City of Newport Beach and its citizens; and WHEREAS, the owners of said property submitted to the Local Agency Formation Commission of Orange County a notice of intention to annex the hereinafter described uninhabited territory, which notice contained the specific boundaries of said territory, pursuant to Section 54792 of the Government Code of the State of California; and WHEREAS, on the 14th day of February, 1968, said Local Agency Formation Commission approved the proposed annexation; and WHEREAS, the owners of all of the land within said ter- ritory proposed to be annexed have either signed the petition or filed with the City Clerk their written consent to said annexation; NOW, THEREFORE, BE IT_RESOLVED by the City Council of the City of Newport Beach that proceedings are hereby initiated pursuant to Sections 35305 and 35310.1 of the Government Code to annex said territory hereinafter described, which territory is contiguous to the present boundaries of said City and which said territory now is unhabited within the meaning of the Annexation of Uninhabited Territory Act of 1939 and that the reasons for owners and the City and its citizens that said City annex said territory. said annexation are that it would make municipal services avail- able to the property owners and be in the best interests of said owners and the City and its citizens that said City annex said territory. NOTICE IS HEREBY GIVEN that it is proposed by said City of Newport Beach to annex said hereinafter described territory to said City, which said territory shall in these proceedings bear the name of "UPPER HARBOR VIEW HILLS ANNEXATION NO. 61 ". The City Clerk of the City of Newport Beach is hereby authorized and directed to cause a copy of this resolution to be published at least once in the official newspaper of the City, said publication to be completed at least four days prior to the date set for the hearing.
