HomeMy WebLinkAbout6774 - Balboa Bay Club;;` - y THS :mec 5/8/68 RESOLUTION N0, 6774 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE BALBOA.BAY CLUB, INC., TO SUBLET CERTAIN PORTIONS OF THE BALBOA. BAY CLUB PREMISES AND ESTABLISHING THE RATE OF RENTAL PAYMENTS TO THE CITY FOR SUBLEASES OF THE BALBOA BAY CLUB PREMISES FOR COMMERCIAL PURPOSES FOR TERMS IN EXCESS OF ONE YEAR WHEREAS, the City of Newport Beach and the Balboa Bay Club, Inc., entered into a lease dated March 24, 1948, whereby the City as lessor leased to the Balboa Bay Club, Inc,, certain real property located within the City; And WHEREAS, said lease provides that Balboa Bay Club, Inc., shall not sublet the premises described in said lease, or any part thereof, for the purpose of operating and conducting any business enterprise at, in, or about the same for a term in excess of the period of one year without the written consent of the City first had and obtained; and WHEREAS, Balboa Bay Club, Inc,, has requested that the City Council approve two subleases which, after consideration thereof, the City Council wishes to approve; NOW, THEREFORE, BE IT RESOLVED as follows: 1, The City Council hereby approves the following pro- posed subleases: ao A sublease between the Balboa Bay Club, Inc,, lessor, and Vivian L. Sloan, lessee, for a term of five years. The purposes for which the premises are subleased are the operation of a women's beauty parlor and for the sale of cosmetics and beauty accessories incidental thereto. b. A sublease between the Balboa Bay Club, Inc., lessor, and Raymond Kemp, lessee, for a term of five years. The subleased premises are to be used for the purpose of retail sales of men's and women's clothing and accessories, 2. It is mutually agreed between the City and the Balboa Bay Club, Inc., that the consideration to be paid to the City for all subrentals received by the Balboa Bay Club, Inc., from any and all subtenants carrying on any part or portion of the leased or subleases providing for a term of based upon the following formula; 2m1/2% of the first $1,000 2% of the second $19000 of on and conducting a business premises under any sublease more than one year shall be of gross sales per month; gross sales per month; and 1m1/2% of the balance of gross sales per month.
