CLOSING UP AND ABANDONMENT.OF A PORTION OF A CERTAIN STREET KNOWN AS BAY AVENUE WHEREAS, the City Council of the City of Newport Beach did, on the 13th day of May, 1968, pass its certain Resolution of Intention No. 6763, declaring its intention to order the va- cation, closing up and abandonment of a portion of a certain street known as Bay Avenue, in the city of Newport Beach, herein- after more particularly described, pursuant to and in accordance with the 07Street Vacation Act of 194119, and all amendments thereto, being Sections 8300 to 8331, inclusive, of the Streets and Highways Code of the State of California; and WHEREAS, the Street Superintendent of the City of Newport Beach has caused to be posted conspicuously along the line of the portion of said street proposed to be vacated, not more than 300 feet apart, and not less than three in all, notices of the vacation of said portion of said street, all of which will more fully appear from the affidavit of Joseph T. Devlin, Street Superintendent of the City of Newport Beach, on file in these proceedings; and WHEREAS, said notices so posted by the Street Super- intendent of the City of Newport Beach stated the.passage of said Resolution of Intention No. 6763 aforesaid, and the time and place of the hearing of all persons interested in or object- ing to the proposed vacation of said portion of said street; and WHEREAS, the City Council of the City of Newport Beach did set Monday, June 10, 1968, at 7:30 P.M. of said day as the time, and the Council Chamber of the City Council of the City of Newport Beach, located in the City Hall of the City of Newport Beach, as the place, for the hearing of all persons interested in or objecting to the proposed vacation of said portion of said �I li street; and 2 CEREAS, said Resolution of Intention Nom 6763 afore - 3 said has been published at least once in the Newport Harbor Ensign, 4 the official newspaper of the City, and said publication was made 5 more than 15 days prior to the date set for the hearing of all g persons interested in or objecting to the proposed vacation, all 7 of which will more fully appear by the affidavit of Arvo E. Haapa, Jprinter and Publisher of the Newport Harbor Ensign, on file in 9 these proceedings; and 10 WHEREAS, the City Council of the City of Newport Beach 11 has heard the evidence, both written and verbal, of all persons 12I interested in the vacation of said portion of said street in this 13 resolution more particularly hereinafter described, and finds from 14 all the evidence submitted that said portion of said street describ 15 in said Resolution of Intention, and hereinafter described, is un- 16 necessary for present or prospective public street purposes; 17 NOW, THMFORE, the City Council of the City of Newport 18 Beach finds and determines and hereby orders that the following 191 described portion of that certain street known as Bay Avenue in 20 the City of Newport Beach, to wit; 21 That portion of Bay Avenue as shown on the Map of Balboa Tract recorded in Book 4, Page 11 of Miscel- 22 laneous Maps records of Orange County, California, lying easterly of the easterly line of "A" Street 23 and lying northerly of and adjacent to Lots 1, 2 and ' 3 of Block 13 of said Balboa Tract, 241 25 is unnecessary for present or prospective public street purposes, 26 and that it be vacated, closed up and abandoned. 27 The City Council further finds anddetermines, and it is • 28 hereby ordered, that the public easement in the portion of said 29 street as heretofore described has, upon the passage of this 30 resolution, ceased. 31 The City Council further orders that the City Clerk of 32.1 the City of Newport Beach shall cause a certified copy of this II2* a 1 2 3, 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 29 30 31 32 Order, duly attested by her as the City Clerk, under the seal of the City, to be recorded in the office of the County Recorder of the County Of Orange, State of California, immediately following the passage of this resolution.
