HomeMy WebLinkAbout6873 - Weed AbatementRESOLUTION N0, 6 87 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE FIRE CHIEF TO ABATE WEEDS AND OTHER • PUBLIC NUISANCES EXISTING UPON STREETS, ALLEYS, SIDEWALKS, PARKWAYS AND PRIVATE PROPERTY WITHIN THE CITY As WHEREAS, on September 10 , 1968, the City Council of the City of Newport Beach adopted Resolution No, 6869 entitled- "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING THAT WEEDS AND OTHER PUBLIC NUISANCES EXIST UPON STREETS, ALLEYS, SIDEWALKS, PARKWAYS, AND PRIVATE PROPERTY WITHIN THE CITY, DECLARING THAT SAID WEEDS AND PUBLIC NUISANCES MUST BE ABATED, SETTING THE TIME AND PLACE FOR A PUBLIC HEARING AT WHICH THE CITY COUNCIL WILL CONSIDER PROTESTS FROM PERSONS OBJECTING TO THE PROPOSED DESTRUCTION OR REMOVAL OF SUCH PUBLIC NUISANCES BY THE CITY, AND DIRECTING THE FIRE CHIEF TO GIVE NOTICE OF THE PASSAGE OF THIS RESOLUTION AND OF THE PUBLIC HEARING ", pursuant to the authority contained in Chapter 10048 of the Newport Beach Municipal Code; and WHEREAS, the City Council has held a hearing to consider all protests to the proposed destruction or removal of the weeds and other public nuisances described in said Resolution No, 6869 and has taken final action as to all such protests in accordance with Section 100480060 of the Newport Beach Municipal Code; NOW„ THEREFORE, BE IT RESOLVED.- SECTION to The Fire Chief is hereby directed to abate such weeds and other nuisances as described in Resolution No, 6869 , or cause the same to be abated, by having the same destroyed or removed. SECTION 2, Any property owner shall have the right to destroy or remove such weeds and other nuisances himself, or have the same removed at his own expense, provided that such weeds and other nuisances shall have been removed to the satisfaction of the Fire Chief prior to • the arrival of the Fire Chief or his authorized representative to remove them. 40 ADOPTED this 23rd day of September , 19 68, ATTEST O _ City Clerk IPIED AS 4THE NACITY CLERK OF THE Cg4T BEACH DAie °' I I %Tom
