RESOLUTION NO. 6875
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
• NEWPORT BEACH APPROVING THE PROPOSED SETTLEMENT
OF THE LITIGATION INVOLVING THE DETERMINATION
OF WATER RIGHTS IN THE SANTA ANA RIVER SYSTEM
ENTITLED "ORANGE COUNTY WATER DISTRICT V. CITY
OF CHINO, SUPERIOR COURT CASE - NO_. 117628" AND
AUTHORIZING THE MAYOR AND CITY ATTORNEY TO
- EXECUTE A STIPULATION RE DISMISSAL OF CERTAIN
NAMED CROSS- DEFENDANTS INCLUDING THE CITY OF
NEWPORT BEACH
WHEREAS, in October, 1963, the Orange County Water
District commenced a lawsuit in the Superior Court of Orange
County against all upstream parties who produce water from the
Santa Ana River system above Prado Dam, entitled "Orange County
Water District v. City of Chino, et al", Case No. 117628; and
WHEREAS, several of the parties named as defendants in
the above entitled lawsuit filed cross - complaints against water
users in Orange County, including the City of Newport Beach.
WHEREAS, Resolution No. 6634 was adopted by the City
Council on August 28, 1967, authorizing the Board of Directors of
the Orange County Water District to provide legal representation
on behalf of the City of Newport Beach; and
WHEREAS, legal counsel for all parties have agreed upon
a settlement of the lawsuit without proceeding to trial, which
settlement sets forth a physical solution to the allocation of
water in the system;
NOW, THEREFORE9 BE IT RESOLVED that the Mayor and City
Attorney are hereby authorized to execute a stipulation re dis-
missal of certain cross - defendants, which dismissal shall be in
consideration of the stipulation by the cross - defendants to the
covenants contained therein.
ADOPTED this 23rd day of September, 1968.
