HomeMy WebLinkAbout6886 - Assessment District 51 - West Newport Street & Alley ImprovementsRESOLUTION N0, 6 88 6 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO ORDER CERTAIN CHANGES IN THE TERRITORY TO BE INCLUDED WITHIN ASSESSMENT DISTRICT N0, 51 PURSUANT TO THE "IMPROVEMENT ACT OF 1911" AND GIVING NOTICE OF HEARING THEREON WHEREAS, on October 7, 1968, the City Council of the City of Newport Beach adopted Resolution No. 6878 determining necessary proceedings for waiver of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, Division 4 of the California Streets and Highways Code, in connection with proposed Assessment District No. 51, and setting a hearing for October 28, 1968, at the hour of 7.30 p.m. before the City Council; and WHEREAS, on October 7, 1968, the City Council also adopted Resolution No, 6879 declaring its intention to order the construction of certain street improvements in Assessment District Noe 51, pursuant to the Improvement Act of 1911, and setting October 28, 1968, at the hour of 7:30 p.m. before the City Council as the time and place for hearing objections to said work; and WHEREAS, subsequent to the adoption of said Resolution of Intention No, 6879 it was learned that certain locations had been inadvertently omitted from, and that one location had been inadvertently added to, Section 1 of said Resolution of Intention, which describes the work proposed and the locations in which said work is to be done; and WHEREAS, the plans and specifications for the improvements • to be constructed pursuant to said Improvement Act of 1911, and a map showing the boundaries and extent of said Assessment District No, 51, are on file in the offices of the City Clerk and the City Public Works Director, reference to which plans and specifications and map is hereby made for further information; and WHEREAS, Section 5232 of the California Streets and High- ways Code authorizes the City Council to order changes and to correct -1- F such omissions by resolution; NOW, THEREFORE, BE IT RESOLVED by the City Council of the • City of Newport Beach thato . Section le The public interest and convenience require, and it is the intention of the City Council of the City of Newport Beach to order, certain work to be done pursuant to the improvement Act of 1911, in the following locations: LUGONIA STREET between Seashore Drive and Ocean Front, including work in the intersection of Seashore Drive and Lugonia Street, as shown on Sheet 6 of said plans; and in ALLEY (un- named) parallel with 33rd Street, between 33rd Street and 34th Street, from Seashore Drive southerly to the alley parallel with Ocean Front, as shown on Sheet 9 of said plans, reference is hereby made to Resolution of Intention No, 6879 adopted by the City Council of the City of Newport Beach on October 7, 1968, and to the plans and specifications and map of Assessment District No, 51, which are on file in the offices of the City Clerk and the City public Works Director, for further information concerning the nature and the extent of the proposed work, Section 2, The following location is hereby deleted as a location in which said work is to be done: ALLEY (un- named) parallel with Ocean Front between 31st and 32nd Street, as shown on Sheet 9 of said plans, Section 3. It has been determined that there will be no increase or decrease in the cost of the work by reason of the addi- tion or deletion of said locations, • Section 4, Notice is hereby given that on the 1j1A day of A/avg &n , 1968, at the hour of Z:,� p. m. in the 40 Council Chambers of the City Council of the City of Newport Beach, in the City Hall at 3300 West Newport Boulevard, Newport Beach, California, any persons having any objections to the proposed changes may appear before the City Council and show cause why said changes -2- .. N. should not be ordered. Written objections to the proposed changes may be filed with the City Clerk by any interested persons at any . time not later than the time set for the hearing; - Section 5. The City Clerk is directed to publish this Resolution of Intention in the NEWPORT HARBOR ENSIGN one time at • 40 least ten (10) days prior to the date of the hearing. The City Clerk is further directed to mail a copy of this Resolution of Intention to all persons owning real property within the locations described in Section 1 of this Resolution of Intention, whose names and addresses appear on the last equalized assessment roll, or as otherwise known to the City Clerk, at least fifteen (15) days prior to the date of the hearing.
