HomeMy WebLinkAbout6887 - Irvine Avenue Vacation & Abandonmentr 1 2 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 THS:mh 10/15/68 na c Yu - RESOLUTION NO. 6882 g'I ?� El 3 .5g69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE VACATION, CLOSING UP AND ABANDONMENT OF A PORTION OF A CERTAIN STREET KNOWN AS IRVINE AVENUE WHEREAS, the City Council of the City of Newport Beach did, on the 7th day of October, 1968, pass its certain Resolution of Intention No. 6881, declaring its intention to order the vacation, closing up and abandonment of a portion of a certain street known as Irvine Avenue, in the City of Newport Beach, here- inafter more particularly described, pursuant to and in accordance with the 11Street Vacation Act of 19411°, and all amendments thereto, being Sections 8300 to 8331, inclusive, of the Streets and Highways Code of the State of California; and WHEREAS, the Street Superintendent of the City of Newport Beach has caused to be posted conspicuously along the line of the portion of said street proposed to be vacated, not more than 300 feet apart, and not less than three in all, notices of the vacation of said portion of said street, all of which will more fully appear from the affidavit of Joseph T. Devlin, Street Superintendent of the City of Newport Beach, on file in these proceedings; and WHEREAS, said notices so posted by the Street Superin- tendent of the City of Newport Beach stated the passage of said Resolution of Intention No. 6881 aforesaid, and the time and plA_� of the hearing of all persons interested in or objecting to the proposed vacation of said portion of said street; and WHEREAS, the City Council of the City of Newport Beara- did set Monday, October 28, 1968, at 7:30 p.m. of said day as time, and the Council Chamber of the City Council of the City o Newport Beach, located in the City Hall of the City of Newport 0 • 11 Beach, as the place for the hearing of all persons interested in 2 or objecting to the proposed vacation of said portion of said 3 street; and 4 WHEREAS, said Resolution of Intention No. 6881 aforesaid 5' has been published at least once in the Newport Harbor Ensign, the 6 official newspaper of the City, and said publication was made more 7 than 15 days prior to the date set for the hearing of all persons i 8 interested in or objecting to the proposed vacation, all of which 9 will more fully appear by the affidavit of Arvo E. Hasps, Printer 10 and Publisher of the Newport Harbor Ensign, on file in these pro - 11 ceedings; and 12 WHEREAS, the City Council of the City of Newport Beach 13 has heard the evidence, both written and verbal, of all persons 14 interested in the vacation of said portion of said street in this 15 resolution more particularly hereinafter described, and finds from 16 all the evidence submitted that said portion of said street 17 described in said Resolution of Intention, and hereinafter 18 described, is unnecessary for present or prospective public street 19 purposes; 20 NOW, THEREFORE, the City Council of the City of Newport 21 Beach finds and determines and hereby orders that the following 22� described portion of that certain street known as Irvine Avenue 23 in the City of Newport Beach, to wit: 24! That portion of Lots 318 and 328 of Newport Heights as shown on a map filed in Book 4, page 83 of Miscellaneous 25 Maps in the office of the County Recorder of said County, which lies within Irvine Avenue Extension as described in a 26 deed to the County of Orange, recorded June 1, 19.53 in Book 2512, page 444 of Official Records of said County, 27 bounded on the East by the Westerly right of way line of Irvine Avenue, 100.00 feet wide, as described in a deed to 28 the City of Newport Beach recorded May 16, 1968 in Book 8603, page 885 of said Official Records and bounded Southerly by 29 a line that bears South 760 19' 41" West from the Northerly terminus of that certain course described as "N. 13° 40' 30 1901 W. 110.24 feet" in Parcel 1 of said deed to the City of Newport Beach; 31 32 is unnecessary for present or prospective public street purposes, -2- 11 and that it be vacated, closed up and abandoned. 2j The City Council further finds and determines, and it is I 3j hereby ordered, that the public easement in the portion of said 00 4I street as heretofore described has, upon the passage of this 5i resolution, ceased. 6 The City Council further orders that the City Clerk of 7 the City of Newport Beach shall cause a certified copy of this $ Order, duly attested by her as the City Clerk, under the seal of 9 the City, to be recorded in the office of the County Recorder of 10 the County of Orange, State of California, immediately following 11 the passage of this resolution. 12 ADOPTED this [-oJ day of ' 7 -0he_R , 1968. 13 14 15 95 yor 16 !
