A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS FAVORABLE CONSIDERA-
TION OF AND SIGNIFYING ITS PRELIMINARY CONSENT
IN PRINCIPLE TO THE ANNEXATION OF TERRITORY KNOWN
AS UPPER HARBOR VIEW HILLS, PHASE II, TO THE CITY
OF NEWPORT BEACH
WHEREAS, an application for an annexation of a parcel
of land to the City of Newport Beach has been submitted to the
County of Orange Local Agency Formation Commission by all of the
owners within the territory; and
WHEREAS, the area proposed to be annexed contains
approximately 106 acres of unincorporated territory located
easterly of MacArthur Boulevard and northerly of the present
northeast City boundary in the Harbor. View Hills area designated
as the Upper Harbor View Hills, Phase II, Annexation; and
WHEREAS, the Local Agency Formation Commission has
given notice of its intention to conduct a public hearing on
November 6, 1968, on the proposed annexation to the City of
Newport Beach; and
WHEREAS, the City Council has reviewed and considered
the applicant's proposal for annexation; and
WHEREAS, Section 54797.1 of the California Government
Code provides that where an application for annexation to a City
is signed by all the property owners within the territory, the
Local Agency Formation Commission may approve the annexation
without notice and hearing and may further authorize the legis-
lative body of the City to annex such territory without notice
• and hearing by the legislative body and without an election;
NOW, THEREFORE, BE IT RESOLVED that the City Council
hereby expresses its preliminary approval in principle of the
proposed annexation of Upper Harbor View Hills, Phase II, to
the City of Newport Beach so as to enable further and more
detailed study to determine the feasibility of annexation.

BE IT FURTHER RESOLVED that the City Council requests
the Local Agency Formation Commission to grant authorization to
the City of Newport Beach to annex such territory without notice
and hearing by the legislative body.
